generate large amounts of traffic that would exceed the capacity of the roads accessing the site. Therefore the <br />criterion is met. <br /> <br />(b) If the use will remain after the area is urbanized it will be located in such a manner that any significant <br />unused portion of the property has adequate development options. <br /> <br />The proposed use of the site will render much of the property as an open lot for car parking. Most of the <br />development would be the surfacing of the property required for the use. As such, the parcel will be open or <br />unused portion of the property would still have significant development potential. Therefore the criterion is met. <br /> <br />(c) The use and related structures and improvements meet the development standards of the most restrictive <br />zone consistent with the applicable comprehensive plan designation; or the city concurs and, if the city <br />requests, conditions are imposed that require the structures and improvements to be brought into confor- <br />mance with city zoning regulations upon annexation. <br /> <br />The most restrictive zone used in the applicable Comprehensive Plan designation is the IC (Industrial <br />Commercial) zone. As referenced in the IC zone code 16.09.100, the development standards of chapters 16.26 <br />through 16.34 are applicable to all lots, structure and uses. MCC 16.26.580 lists development requirements for <br />uses that are under the classification of SIC 75, which includes both towing services and automobile dismantlers. <br />The standards outlined under this section, and all those applicable in the other aforementioned sections, shall be <br />made a condition of approval so that the new uses and improvements on the subject parcel are compliant with the <br />development standards of the most restrictive zone allowed under the Comprehensive Plan designation. <br /> <br />The City of Salem also provided comments regarding development standards under their code. Some of these <br />sections were specifically requested to be made conditions of approval as part of the development, mostly in <br />relation to sufficient upgrades to the property access connecting to Timbet Dr, a road under the jurisdiction of the <br />City of Salem. The standards specifically requested to be conditioned shall be made conditions of approval. All <br />other standards shall be recommended to the applicants, but not required as conditions of approval. <br /> <br />Subject to completion of all conditioned development requirements, the criterion can be met. <br /> <br />(d) The most restrictive zone used in the applicable Comprehensive Plan designation lists the proposed use <br />as a permitted or conditional use; or the city concurs and, if the city requests, conditions are imposed <br />which require that the use be brought into conformance with city zoning regulations upon annexation. <br /> <br />The most restrictive zone used in the applicable Comprehensive Plan designation is the IC (Industrial <br />Commercial) zone. The IC zone lists SIC 75 as a permitted use within the zone, which the proposed uses were <br />determined to fit under. Also, the City of Salem provided comments regarding uses and potential future zones that <br />are consistent with their comprehensive plan designation and uses that are allowed within those zones. The <br />proposed uses of a towing business and automobile dismantler would both be permitted within at least one of the <br />potential zones. Therefore the criterion is met. <br /> <br />8.
