The applicants are proposing to replace one dwelling on a 36-acre parcel and another dwelling on a 26.17-acre <br />parcel on two Timber Conservation zoned parcels where the dwellings were destroyed in the 2020 Beachie Creek <br />Fire. <br /> <br />6. Various agencies were contacted about the proposal and given an opportunity to comment. <br /> <br />Public Works Land Development and Engineering Permits (LDEP) requested that the following be included in the <br />land use decision. <br /> <br /> Engineering Requirements: <br /> <br />A. Transportation System Development Charges (TSDCs) and Parks fee may be assessed upon <br />application for building permits. Please note that a limited duration waiver on those assessments <br />for properties impacted by the September 2020 Beachie Creek Fire is currently in place until the <br />end of calendar year 2025. <br /> <br />Marion County Building Department commented: <br />Permit(s) are required to be obtained prior to the development of replacement dwelling(s), other structures subject <br />to the state building code, and/or utilities installation on private property. Depending on the proposed locations for <br />these structures, the soils conditions, and/or adjacent grades, a geotechnical assessment of these conditions may be <br />necessary to meet code compliance for building permit issuance or foundation inspection approval. <br /> <br />Marion County Septic commented: <br />Conditions of Approval: An Authorization is required to connect the replacement dwelling to the existing septic <br />system on both lots. If the dwelling on 10750 Wagner is proposed to move >100’ from its current location, and a <br />new system is proposed, a site evaluation followed by a construction-installation permit is required. If the dwelling <br />on 10750 Wagner is proposed to move <100’ from its previous location, and a new system is proposed, a major <br />repair/alteration is required. <br /> <br />Additional Info: Each dwelling must be connected to its own system. The system serving 10754 Wagner was <br />installed under permit 10-06364 and a record review was conducted on the existing system serving 10750 Wagner <br />under permit 555-01-06383. <br /> <br />All commenting agencies did not respond or stated no objection to the proposal. <br /> <br />7. Restoration or replacement of a use under ORS 215.130 (5) or under city land use regulations that allow the <br />restoration or reestablishment of a nonconforming use, including under section 2 of this 2021 Act, must commence <br />no later than September 30, 2025, notwithstanding the time limitation under ORS 215.130 (6) or any other local
