<br />7. All or a portion of this property has been identified as being located in a "Groundwater Limited Area" as defined <br />by the Oregon State Water Resources Department. The applicant is advised to contact Water Resources, (503) <br />378-3739, regarding possible restrictions or limitations on use of groundwater in the area. <br /> <br />8. The applicants should contact Marion County Land Development and Engineering (503-584-7714) for additional <br />Engineering Requirements and Advisories, listed in Finding #6 below, that may be required. <br /> <br />APPEAL PROCEDURE: The Marion County Zone Code provides that certain applications be considered first by the <br />County Planning Director. If there is any doubt that the application conforms with adopted land use policies and regula- <br />tions the Director must condition or deny the application. Anyone who disagrees with the Director's decision may request <br />that the application be considered by a Marion County hearings officer after a public hearing. The applicant may also <br />request reconsideration (one time only and a fee of $200) on the basis of new information subject to signing an extension <br />of the 150 day time limit for review of zoning applications. <br /> <br />A public hearing is held on appeals subject to the appellant paying a $250.00 fee. Requests for reconsideration, or <br />consideration by a hearings officer, must be in writing (form available from the Planning Division) and received in the <br />Marion County Planning Division, 5155 Silverton Rd. NE, Salem, by 5:00 p.m. on October 3rd, 2025. If you have <br />questions about this decision contact the Planning Division at (503) 588-5038 or at the office. This decision is effective <br />October 6th, 2025, unless further consideration is requested. <br /> <br />FINDINGS AND CONCLUSIONS: Findings and conclusions on which the decision was based are noted below. <br /> <br />l. The subject property is designated Farm/Timber in the Marion County Comprehensive Plan. The major purpose <br />of this designation and the corresponding Farm/Timber zone is to promote the continuation of commercial <br />agricultural and forestry operations. <br /> <br />2. The property is located is located on Cloverdale Dr SE, approximately one mile southeast of where Cloverdale Dr <br />SE intersects Enchanted Way SE. There are a couple small areas of mapped geohazard on the northern half of the <br />subject property. There are no streams, floodplains, of wetlands mapped on the subject property. The property <br />was the subject of previous land use cases in 2011 (ZC11-002 & AR11-031) and is therefore considered legal for <br />land use purpos <br /> <br />3. Surrounding properties to the west, north and east are zoned SA (Special Agriculture) and in various types of farm <br />or timber use. Properties directly to the south across Cloverdale Dr SE are zoned AR (Acreage Residential) and in <br />use for rural residential properties. Outside of this southern AR neighborhood are parcels zoned SA and in use for <br />a mix of agriculture, timber, and rural residential uses. <br /> <br />4. Soil Survey of Marion County Oregon indicates 100% of the subject property is composed of high-value farm soils. <br /> <br />5. The applicant is proposing to expand an existing equine facility to establish Equine Assisted Mental Health <br />(EAMH) and Equine Assisted Learning (EAL) services as a commercial use in conjunction with agriculture. <br /> <br />6. Public Works Land Development and Engineering Permits (LDEP) requested that the following be included in the <br />land use decision. <br /> <br /> <br /> ENGINEERING REQUIREMENTS <br /> A. Submission of a civil engineering site development plan is required. <br /> B. Stormwater detention may be required at 0.5-ac of development. <br /> C. Utility service extensions within the public Right-of-Way require permitting through PW Engineering. <br /> D. Transportation System Development Charges (SDCs) will be assessed at the time of application for building <br /> permits. <br /> <br /> ENGINEERING ADVISORY <br /> E. DEQ has jurisdiction over erosion control for ground disturbances of 1.0 acre plus.
