The applicants should contact the Aurora Fire District to obtain a copy of the District’s Recommended Building <br />Access and Premise Identification regulations and the Marion County Fire Code Applications Guide. Fire District <br />access standards may be more restrictive than County standards. <br /> <br />APPEAL PROCEDURE: The Marion County Zone Code provides that certain applications be considered first by the <br />County Planning Director. If there is any doubt that the application conforms with adopted land use policies and regula- <br />tions the Director must condition or deny the application. Anyone who disagrees with the Director's decision may request <br />that the application be considered by a Marion County hearings officer after a public hearing. The applicant may also <br />request reconsideration (one time only and a fee of $200) on the basis of new information subject to signing an extension <br />of the 150 day time limit for review of zoning applications. <br /> <br />A public hearing is held on appeals subject to the appellant paying a $250.00 fee. Requests for reconsideration, or <br />consideration by a hearings officer, must be in writing (form available from the Planning Division) and received in the <br />Marion County Planning Division, 5155 Silverton Road NE, Salem, by 5:00 p.m. on September 22nd, 2025. This decision is effective <br />September 23rd, 2025, unless further consideration is requested. <br /> <br />FINDINGS AND CONCLUSIONS: Findings and conclusions on which decision was based are noted below. <br /> <br />1. The subject properties are designated Primary Agriculture in the Marion County Comprehensive Plan and <br />correspondingly zoned EFU (Exclusive Farm Use. The primary intent of the EFU (Exclusive Farm Use) zone is <br />to provide areas for continued practice of commercial agriculture. These areas are generally well suited for large- <br />scale farming. The EFU zone is also intended to allow other uses that are compatible with agricultural activities, <br />to protect forests, scenic resources and fish and wildlife habitat, and to maintain and improve the quality of air, <br />water and land resources of the county. <br /> <br />2. The properties are located west of Butteville Rd NE, approximately ½ mile north of the intersection of Butteville <br />Rd NE and Ehlen Rd NE. Parcel 3 (Tax lot 700) is also located directly south of Matthieu Ln NE. Tax lots 600 <br />and 700 have access off Matthieu Ln NE and Tax lot 800 has access off Butteville Rd NE. All three parcels are in <br />active farm operation. Tax lot 700 contains one dwelling built in 1911 and tax lot 800 contains one dwelling built <br />in 1957, and both have multiple farm buildings. Tax lot 600 is unimproved. <br /> <br /> Tax lot 700 was the subject of land use case CU88-117 in which the property was approved for a temporary <br />medical hardship dwelling. Tax lots 800 and 600 were described as Tract 1 and Tract 2 in a deed recorded in 1974 <br />(Reel 197 Page 1336) and have not changed their configuration since. Therefore, all three parcels are considered <br />legal for land use purposes. <br /> <br />3. Adjacent properties are all zoned EFU and vary in size. The surrounding larger parcels appear to be in active farm <br />operation, and many are improved with homesites. <br /> <br />4. Soil Survey for Marion County, Oregon, indicates approximately 99.9% of the soils on the subject tax lots are <br />classified as high value. <br /> <br />5. The applicants are proposing to adjust the property lines on a 6.53-acre parcel, 32.70-acre parcel and a 28.02-acre <br />parcel, resulting in the creation of a 60.68-acre parcel, a 4.24-acre parcel, and a 5.12-acre parcel. The applicants <br />intend to consolidate the farmland while reducing the size of the homesites. <br /> <br />6. Various agencies were contacted about the proposal and given an opportunity to comment. <br /> <br />Marion County Surveyor’s Office commented: <br /> <br />a. No survey required for properties greater than ten acres per ORS 92.060 (8). <br />b. Properties 10 acres or less must be surveyed per ORS 92.060 (7) and the survey submitted for review. <br />c. Survey checking fee required at the time of review. <br />d. Property line adjustment deed(s) shall be recorded with the Marion County Clerk’s Office. Per ORS <br />92.190 (4).
