from the floodplain. Both LOMA applications were denied by FEMA. In The two areas of the subject <br />parcel were provided with BFEs from FEMA in these LOMAs. <br /> <br />The first area is a space in the southwestern area of the parcel, which is where the septic system is <br />currently authorized to be placed. The elevations in this area were surveyed and a LOMA was applied for <br />in 2023 by Barker Surveying. The BFE for this area of the parcel was determined by FEMA to be 334.5’ <br />(NAVD 88), and the lowest lot elevation was measured at 329.3’. The largest area surveyed for this <br />LOMA is between 330’ and 331’ MSL (Mean Sea Level). To elevate to 2’ above BFE this area will <br />require the bottom of the longitudinal chassis to be elevated at least 6’ above grade. <br /> <br />The second area in which a LOMA was applied for is the area around the original dwelling site, in the <br />northeast corner of the parcel. This LOMA was applied for in 2025 by Barker Surveying. FEMA denied <br />the LOMA and provided the BFE of 335.7’ (NAVD 88) in this area. The lowest lot elevation was <br />measured at 328.1’. The largest area surveyed for this LOMA sits around 331.5’ MSL. To elevate to 2’ <br />above BFE this area will require the bottom of the longitudinal chassis to be elevated at least 6’ above <br />grade. <br /> <br />The applicant seeks to replace the home in the original location, in the northeastern corner of the property. <br />The other location will serve as a backup if upon further investigation it appears to be more feasible. Both <br />of these potential locations have BFEs provided by FEMA. The criterion is met. <br /> <br />C. Prior to obtaining a building permit the owner shall be required to sign and record in the deed records <br />for the county a declaratory statement binding the landowner, and the landowner’s successors in interest, <br />acknowledging that the property and the approved development are located in a floodplain. <br /> <br /> The signing of a declaratory statement will still be made a condition of approval. <br /> <br />D. Prior to obtaining a building permit, commencing development or placing fill in the floodplain the <br />applicant shall submit a certification from a registered civil engineer demonstrating that a development <br />or fill will not result in an increase in floodplain area on other properties and will not result in an <br />increase in erosive velocity of the stream that may cause channel scouring or reduce slope stability <br />downstream of the development or fill. <br /> <br />The applicant shall provide evidence in the form of engineer certification that the proposed manufactured <br />home placement complies with this criterion as a condition of approval. It is important again to note that <br />due to FEMA still considering this property within a Linn County FIRM, the elevation certificate must <br />use NAVD 88 for elevations, instead of NGVD 29 which is the standard for elevation certificates within <br />Marion County. <br /> <br />E. The applicant shall provide an elevation certificate signed by a licensed surveyor or civil engineer <br />certifying that the actual elevations (in relation to mean sea level) of the lowest floor (including <br />basement) and all attendant utilities of all new or substantially improved residential structures including <br />manufactured dwellings meet the requirements of MCC 17.178.060(A), (B) and (C), where applicable, as <br />follows: <br /> 1. Prior to construction (based on construction drawings); and <br /> 2. Once the floor elevation can be determined (based on the building under construction); and <br /> 3. Prior to occupancy (based on finished construction). <br /> <br />This proposal is for a residential structure, the applicant shall submit an elevation certificate at the times <br />listed above. The first elevation certification, based on construction drawings, was submitted with this <br />application. Submission of the subsequent elevation certificates shall be a condition of approval. <br /> <br />10. MCC chapter 17.178.060 A, & D-H pertain to this project. <br /> <br />A. Residential Structures, Including Manufactured Dwellings and Related Structures. New residential <br />construction, substantial improvement of any residential structures, location of a manufactured dwelling <br />on a lot or in a manufactured dwelling park or park expansion shall: <br /> <br /> 2. Manufactured dwellings shall have the bottom of the longitudinal chassis frame beam, including <br />basement, elevated on a permanent foundation to two feet above base flood elevation. Where the
