property. Other notable uses in the area include the First Free Methodist Church and various commercial <br />businesses along Silverton Rd. <br /> <br />4. The applicant proposes to divide a 0.58-acre parcel into two parcels containing 12,722 square feet and 12,546 <br />square feet respectively. The intention (as said in the applicant statement and shown on their site plan) is to site a <br />4-plex dwelling structure on each resultant parcel. <br /> <br />5. Various agencies were contacted about the proposal and given an opportunity to comment. <br /> <br /> Marion County Surveyor’s Office commented: <br /> <br />1. Parcels 10 acres or less must be surveyed and monumented. <br />2. Per ORS 92.050, plat must be submitted for review. <br />3. Checking fee and recording fees required. <br />4. A current or updated title report must be submitted at the time of review. Title reports shall be no more <br />than 15 days old at the time of approval of the plat by the Surveyor’s Office, which may require <br />additional updated reports. <br /> <br />Marion County Tax Assessor’s Office commented that there are unpaid taxes which have become a lien on the <br />property and that according to ORS 92.095, all delinquent taxes and interest as well as taxes which have become a <br />lien during the tax year must be paid before a partition can be recorded. <br /> <br /> This issue will be addressed through a condition of approval requiring all taxes due must be paid prior to <br />recording the partition plat. <br /> <br />Public Works Land Development and Engineering Permits (LDEP) requested that the following be included in the <br />land use decision. <br /> <br /> Requirements: <br /> <br />A. Design of stormwater detention including Water Quality Treatment will be required prior to <br />issuance of building permits. Construction of the stormwater system will be required prior to <br />building occupancy. <br />B. A county erosion control permit is required for ground disturbing activities and final stabilization. <br />C. Transportation System Development Charges (SDCs) & Parks fee will be assessed upon <br />application for building permits for new dwellings. <br />D. Utility extension work in the public right-of-way requires permits from PW Engineering. <br /> <br />Marion County No. 1 Fire District commented: <br /> <br />This project must meet the following code requirements per Marion County Fire District No. 1: <br /> <br />1. Commercial Buildings – Fire Flow: The minimum fire flow and flow duration for buildings other than <br />one and two-family dwellings shall be determined according to OFC Appendix B. The required fire flow <br />for a building shall not exceed the available GPM in the water delivery system at 20 psi. <br /> <br />2. Fire Apparatus Access Roads with Fire Hydrants: Where a fire hydrant is located on a fire apparatus <br />access road, the minimum road width shall be 26’ feet (OFC D103). <br /> <br />3. Fire Hydrant/Fire Department Connection: A fire hydrant shall be located within 100’ feet of a fire <br />department connection (FDC) or as approved by the fire code official. Fire hydrants and FDC’s shall be <br />located on the same side of the fire apparatus access roadway. (OFC 912 & NFPA 13, 13D, & 13R). <br />FDC’s shall normally be remote and outside of the fall line (collapse zone) of the building typically a <br />distance of 1½ times the height of the building, or as approved by the fire code official. <br />
