DRAIN FiELD EASEMENT KNOW ALL MEN BY THESE PRESENTS that CHARLIE M. FERY and CATIIERINE FHRY, husband and wife, hereinafter called Grantor, in consideration of the sum of FIFTY AND NO/100 DOLLARS, ($50.00), does hereby grant, bargain, sell and convey unto SANTIAM WATER CONTROL DISTRICT, a body politic located in Marion and Linn Co%:nties, State of Oregon, hereinafter called Grantee, and unto GrantOe'~ successors and assigns, a certain easement for the construction, maintenance, and repair of a s~ptic tank drain field, for the bene- fit of Grantee'S property located adjacent to the property described heroin on the West and across~ickma~-L~e. This easement is over and across the following described prop- erty, to-wit: A parcel of land, not exceeding one acre in size, and located in the Northwest corner of the following described parcel: Coramenctng on the South line of the Donation Land Claim of Alexander ~eel and Lydia A. Neel, his wife, at a point where said South line is intersected by the section line dividing sectlons 17 and 1~, in Township 9 South, Range 1 West of the Willamette Meridian in Marion County, OregOn; running thence East 20.00 chafns; thence North 39.59 chains, more or less, to the center of the County Road leading from Stayton to West Stayton, Oregon; thence Southwesterly along the center of said road to a point due North of the place of beginning; thence South 36.35 chains; more or less, to the place of beginning, and containing 75.90 acres of land, more or less. Grantee shall have all the rights of ~ngress and egress to and fro~ real estate, includlng the right to remove trees, brush and other obstructions necessary for Grantee's use an~ maintenance of the easement hereby granted, and Grantee agrees that on completion of any construction, repair or re-construction of said septic tank drain field, Grantee will back fi]l an~ retur= the surface of the property to a reasonably level condition.
