A public hearing is held on appeals subject to the appellant paying a $250.00 fee. Requests for reconsideration, or <br />consideration by a hearings officer, must be in writing (form available from the Planning Division) and received in the <br />Planning Division, 5155 Silverton Rd. This decision is effective August 19th, 2025, <br />unless further consideration is requested. <br /> <br />FINDINGS AND CONCLUSIONS: Findings and conclusions on which the decision was based are noted below. <br /> <br />l. The property is designated Industrial in the Salem Area Comprehensive Plan and correspondingly zoned IG <br />(General Industrial) by Marion County. The purpose of this zone is to provide areas suitable for warehousing, <br />secondary processing, packaging and fabricating of finished goods and equipment with related outdoor storage <br />and incidental sales. <br /> <br />2. The property is located on the north side of Boone Rd SE, at the western terminus of the section that intersects <br />Turner Rd SE. The railroad on the western border of the subject parcel separates this section of Boone Rd SE <br />from the rest of the road that stretches west from Eastland to 22nd Ave SE. The subject parcel is within the City of <br />Salem Urban Growth Boundary (UGB) and the Santiam Water Control District. The subject parcel contains an <br />approximately 10,000 square foot structure with mixed office and shop space that was previously used by the <br />wrecking yard that was located on the property. The rest of the property consists of a quarter-acre parking lot, <br />another acre paved with asphalt, and approximately 4-acres of graveled lot. The subject parcel is entirely within <br />the 100-year floodplain of Mill Creek. The property has been the subject of several land use cases, most recently <br />FP03-006, and is therefore legal for land use purposes. <br /> <br />3. Property to the north contains industrial uses and vegetation against Kuebler Boulevard SE and is zoned IG. This <br />same parcel and use wraps around to the east of the subject parcel. Property to the west across the railroad tracks <br />is covered with timber and is also zoned IG. To the south are parcels zoned IC (Industrial Commercial) in use for <br />metal fabrication businesses. <br /> <br />4. The applicant proposes to perform grading, paving and to construct a storm water management system within the <br />100-year floodplain of Mill Creek on the subject parcel in order to create an area for storage of vehicles. <br /> <br />5. Marion County Planning requested comments from various agencies, those that provided comments are: <br /> <br /> Marion County Land Development Engineering and Permits (LDEP) commented: <br /> <br />ENGINEERING CONDITION <br />Condition A – Prior to completion of permitted work to redevelop the site surfacing, dedicate additional public <br /> right-of-way to achieve the Local road standard of a 30-foot half-width along the subject property Boone Road <br /> frontage. <br /> <br />ENGINEERING REQUIREMENTS <br />B. Stormwater detention and water quality treatment will be required. Civil engineering plans and calculations <br />are required for review and approval. <br />C. Because of the presence of a relatively short, curved segment of extruded curbing within the traveled way <br />along the western portion of property frontage it may be required to either remove it or mitigate a potential traffic <br />hazard by for instance installing pavement striping that would need to be shown on the engineering plans. <br /> <br />ENGINEERING ADVISORY <br />D. DEQ has jurisdiction over ground disturbing activities of 5-acres or more. <br /> <br /> Marion County Septic commented: “Marion County does not have record of a septic system serving this property. <br />Note that per OAR 340-071-0130(12), the initial and repair area must not be subject to activity that may adversely <br />affect the soil or function of the system – including but not limited to vehicular traffic, covering the area with <br />asphalt or concrete, filling, cutting, or other soil modification.” <br /> <br />All other contacted agencies either failed to comment or stated no objection to the proposal.
