FINDINGS AND CONCLUSIONS: Findings and conclusions on which the decision was based are noted below. <br /> <br />1. The subject property is designated Farm Timber in the Marion County Comprehensive Plan and zoned <br /> FT (Farm/Timber). The purpose of the FT zone is to maintain properties for farm and timber use. Dwellings may <br />be approved subject to the criteria in the zone. <br /> <br />2. The subject property is located on the east side of Powers Creek Loop NE, approximately 0.70 miles from the <br />intersection of Power Creek Loop NE and Timber Trail Road NE. The property is currently vacant. The property <br />owner provided a deed describing the property in its current configuration as of November 1950 (Volume 423, <br />Page 766). The property was previously the subject of an administrative review (AR21-025) that approved a <br />template test dwelling. It is therefore considered a legal parcel for land use purposes. <br /> <br />3. Properties to the west are zoned FT (Farm/Timber) with some home sites and farms. Properties to the north and <br />are zoned EFU (Exclusive Farm Use) and are in farm and forest production. Properties to the south and east are <br />zoned TC (Timber Conservation) and are in forest production. <br /> <br />4. The following table depicts the soil composition on the property and its capacity to produce wood fiber. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />5. The applicant is proposing to modify conditions of AR21-025 in order to reduce the western setback, thereby <br /> expanding the approved homesite area to accommodate an expansion of an easement across the property that will <br /> utilize portions of the southeastern area initially approved for the homesite. <br /> <br />6. Various agencies were contacted about the proposal and given an opportunity to comment. <br /> <br /> Public Works Land Development and Engineering Permits (LDEP) requested that the following be included in the <br />land use decision. <br /> <br /> ENGINEERING REQUIREMENTS <br /> <br /> A. At the time of application for building permits an Access Permit will be required to establish a record of <br /> access for the proposed dwelling, and as part of that, evidence of a recorded access easement or <br /> associated deed language is required since the property has no public road direct frontage. Availability of <br /> sufficient Intersection Sight Distance will need to be verified by the Engineering Inspector for the <br /> proposed use of an existing driveway approach connection to Powers Creek Loop, possibly known as <br /> Pflaum Lane. <br /> <br /> B. The subject property is within the unincorporated area of Marion County and will be assessed <br /> Transportation System Development Charges (SDCs) & Parks fee upon application for building permits. <br /> <br />C. Utility work in the public right-of-way requires separate PW Engineering permits. <br /> <br /> Marion County Building Inspection commented: “No Building Inspection concerns. Permit(s) are required to be <br />obtained prior to development of structures and/or utilities installation on private property. The adjacent slopes <br />may need to be accounted for in the design of a dwelling, possibly requiring an engineered design.” <br /> <br /> Marion County Septic Inspection commented: “A site evaluation is required to establish an initial and repair area <br />for the septic system. The site evaluation must be completed prior to application of a construction -installation <br />permit.” <br /> <br />All other contacted agencies either failed to comment or stated no objection to the proposal. <br /> <br />7. Administrative Review 21-025 approved the placement of a template test dwelling on the subject parcel. The <br />applicant seeks to modify the setback to the western property line from 130-feet, down to 90-feet. The subject <br />parcel is accessed on an existing easement off Powers Creek Loop.
