(d) The variance will not have a significant adverse affect on property or improvements in the neighborhood <br />of the subject property; and <br />(e) The variance will not have a significant adverse affect upon the health or safety of persons working or <br />residing in the vicinity; and <br />(f) The variance will maintain the intent and purpose of the provision being varied. <br /> <br />7. The subject property is within the FT zone and is 1.19-acres in size. The minimum lot size in the FT zone is 80- <br />acres and the 20-foot minimum setback for residential accessory structures was established both to keep non- <br />resource related buildings away from neighboring farm or forest uses on nearby parcels and because most parcels <br />within this zone are generally much larger than 1.19-acres. The applicant is proposing to site a residential <br />accessory structure 5 feet from the north property line and 10 feet from the eastern property line. The applicant <br />indicated in their site plan and statement that this location is necessary to site the structure away from both the <br />well and septic system. These reasons are enough to satisfy criteria a & b. The applicant indicated that while they <br />were planning on putting the structure farther back than the requested setbacks, they need the additional room in <br />the event there are necessary alterations in the plan that would force the structure to be slightly closer to the <br />property lines. The distance to property lines is typical to that of normal accessory structures in urban areas, and <br />one of the sides the applicant is requesting to reduce the setback from is annexed into Mill City and is residential. <br />The applicant also stated that they will ensure that all runoff is directed back onto the subject property so as to not <br />impact the neighboring properties. The proposed structure is also a shop that will not be inhabited consistently <br />like a dwelling, so conflicts with neighboring farm uses are less likely and it is unlikely that an accessory shop <br />will cause an adverse impact on health and safety. Therefore criteria c through f above are also met. <br /> <br /> 8.
