6.3 The owner of each. parcel respectively sh~ll be sol,ely responsible for <br />the installation, repair, and maintenance of the water I~nes servxng thetr respective <br />parcels. <br /> <br /> 6.4 During the existence of this easement, those holders of an interest in <br />the easement that are responsible for dmnage to the easement because of <br />negligence or abnormal use shall repair the damage at their sole expense. <br /> <br />7. INDEMNIFICATION AND INSURANCE. <br /> <br /> 7. l Grantor agrees to defend, indemnif3~ and hold harmless Grantee fi:om <br />and against any loss, claim or liability arising out of Grantor's interference by act <br />or omission with use and enjoyment of the Easement. <br /> <br /> 7.2 Grantee shall defend, indemnify and hold harmless Grantor from and <br />against any loss, claim or liability arising our of or attributable to use of the <br />Easement by Grantee. <br /> <br />8. PROPERTY TAXES. <br /> <br /> 8.1 Grantee shall p, ay all ad valorem [axes on the Dominant Parcel, except <br />as othe~wvise provided in this document. <br /> <br /> 8.2 Grantor shall pay all ad valorem taxes on the Servient Parcel, except <br />as otherwise provided in this document. <br /> <br />9. REMEDIES ON DEFAULT. <br /> <br /> 9.1 In the event of either party's breach of any of the provisions of this <br />document, the other party shall have all rights and remedies provided by law or in <br />equity, except as otherwise provided in this document. <br /> <br /> 9.2 Both parties waive the right to termination of the Easement, except as <br />other wise provided in this document. <br /> <br />9.3 Attorney Fees: <br /> <br /> A) No Suit or Action Filed. If this Agreement is placed in the hands <br />of an attorney due to a default in the performance of any of its terms, the <br />defaulting party shall pay, immediately upon demand, the other party's reasonable <br />attorney fees, collection costs, even though no suit o~-action is filed thereon, and <br />any other fees or expenses incurred by the nondefaulfing party. <br /> <br /> B) If Suit or Action Filed or Not Filed. If this Contract is placed in <br />the bands of an attorney due to a default in the performance of any of its terms, the <br />defaulting party shall pay, immediately upon demand, the other party's reasonable <br />attorney fees, collection costs, and court costs, whether at trial or upon any appeal <br />thereof, and whether or not a suit or legal action is filed thereon, and any other <br />fees or expenses incurred by the nondefaulting party. <br /> <br />10.
