Easemeni Dated: ("Grantor") To: Roger A. Cone ("Grantee") ' For good and valuable consideration, Grantee hereby grants an easement to Grantee, as follows: 1. DENTIFICATION OF PROPERTIES. 1.1 Grantor owns the real property which is more particularly described, as follows (the "Servient parcel"): Lots I, tho -.Fatst 25 f~£ of Lot 2 and all of Lot 5, Block 1, SHAW, in tho County of Marion, State of Oregon 1.2 Grantee owns the real property which is more particularly described as fo[lows (the "Dominant Parcel"): Lot* 3, 4, and the We.~t 25' of Lot 2 SHAW, Marion County, Oregon. 1.3 Under no ¢ircumsta,~ces shall this easement be construed as a conveyance of any portion of the Servient parcel, except as described herein. 2. GRANT, NATURE, USE AND PURPOSE OF 'EASEMENT. 2.1 Grantor hereby grants, bargains, sells, and conveys to Grantee a non- exclusive easement for use of the existing well (the "Easement") over and across the Servient Parcel. 2.2 The purpose of the Easement is to pro34de the Dominant Parcel with the fight to use and mainta/n the well, pump house, tanks, and other parts and equipment of said well. Said easement shall also include the right to construct and maintain a water supply line to the wel/, for the use and benefit of the Dominant Parcel. Said water supply line shall be reasonably located so as not to unduly interfere with the use and enjoyment of the Servient Parcel.
