Please be advised, that the Agreement for <br />Easement preEared and si~ned by you on November 1, 1994 has been executed by <br />Mr. Cone anal recorded. This was done in accordance with the express oral <br />al~reement between you Mr. Cone, whereby, you agreed to convey this easement to <br />h~m. It is irrelevant, that you hope to breadi this agreement as you stated in your <br />certified letter dated 1/19195. The agreement was matte and your performance tel/ed <br />upon by Mr. Cone, long before your wrote this letter. The execution and recording <br />of the Easement agreement were merely a memorialJzation of the agreement. <br /> <br />Also, Mr. Cone has completed a survey of his property and discovered, that you <br />have a fen'ce and an outbuilding encroaching on his property. Both the fence and <br />the outbuilding, must be removed within 14 days of this letter. Fozyou convenience <br />in removing both, enclosed is a copy of Mr. Cone's survey with the fenceline and the <br />outline of the building drawn in. rot a reference point, Mr. Cone indicates, that the <br />boundary of yourp~operty is 3.5 feet west of the westernmost edge of the house at <br />9358 Silv'er Falls H-wy:-S.E,. Therefore any structure more than th'~t 3.5 feet west of <br />the home is on Mr. Cone's property and'must be removed. This letter is the only <br />courtesy that you will recei~-e fn this matter, if the fence and outbuilding are n& <br />removed,, on the 15th day following this letter, the appropriate legal action will be <br />taken against you persona]ly. <br /> <br />You should direct any inquiry about these matters to this office.
