a partitioning in an AR zone have been satisfied, therefore the <br />application is GR2~NTED, subject to the conditions set forth below. <br />These conditions are necessary for the public health, safety and <br />welfare. <br /> <br />The applicants shall submit a final partitioning plat to <br />the County Surveyor's Office (Senator Building, 2nd <br />Floor, 220 ~igh St. NE). Following plat approval, the <br />plat shall be recorded with the Marion County Clerk. <br /> <br />Prior to submitting the f~al partitioning plat, the <br />applicants shall obtain an approved septic site evalua- <br />tion from the Marion County Building Inspection Division <br />on both resulting parcels. <br /> <br />Ail resulting parcels shall contain a minimum 1.5 acres. <br /> <br />A Partition Plant Service Report, prepared by a title <br />company, will be required upon submission of the final <br />mylar to the County Surveyor. <br /> <br />The applicants shall sign and submit a Declaratory <br />Statement for both parcels to the Planning Division. <br />These statements shall be recorded by the applicant with <br />the Marion County Clerk after it has been reviewed and <br />signed by the Planning Director (Declaratory Statement <br />enclosed). <br /> <br />The applicants shall file a Statement of Water Rights <br />which shall be shown on the final plat. <br /> <br />After the final partitioning plat has been recorded no <br />alteration of property lines shall be permitted without <br />first obtaining approval from the Planning Director. <br /> <br />A special dwelling setback of 100 feet shall be main- <br />tained from the northeast property line (along Mill <br />Creek) of the resulting 3.55 acre parcel. <br /> <br />Applicants must submit proof that Aumsville Rural Fire <br />Protection District access s~andards and premises <br />identification standards have been met. <br /> <br />10· <br /> <br />Any development in the Floddplain area of either parcel <br />shall be in accordance with Marion County floodplain <br />development standards and procedures· <br /> <br />11. <br /> <br />Driveway permits will be required from the Marion County <br />Department of Public Works for any new access or change <br />in existing access to the public right-of-way. <br /> <br />P 94-22~ORDER - 5 <br />YOUNG & ALLEN <br /> <br /> <br />
