In order to approve a commercial activity in conjunction with farm use the applicant must demonstrate <br />compliance with the specific criteria listed in Chapter 17.136.060(D) of the Marion County Code (MCC). These <br />include: <br /> <br />(a) The commercial activity must be primarily a customer or supplier of farm uses. <br /> <br />The proposed activity is an agriculture equipment sales and service facility that will sell and service tractors, <br />combines, mowers and various other pieces of agricultural equipment. This use is both a customer and supplier of <br />farm equipment. The criterion is met. <br /> <br />(b) The commercial activity must enhance the farming enterprises of the local agricultural community to <br />which the land hosting that commercial activity relates. <br /> <br />The use will enhance the local agriculture land by giving farmers a convenient space to buy and service <br />equipment, located along Highway 99E between the cities of Woodburn and Hubbard. This will allow local <br />farmers to drive less and spend less time when buying or repairing equipment. The proposed location near two <br />secondary state highways (Hwy 99E and Hwy 211) will allow customers to quickly get their equipment in for <br />repairs without navigating winding county roads when loading their equipment in and out of the site. This <br />proposal also puts the commercial use near other commercial uses. The criterion is met. <br /> <br />(c) The agricultural and commercial activities must occur together in the local community to satisfy the <br />statute. <br /> <br />This sales and service center is to be located on an active farm and in very close proximity to other active, large <br />scale farms. The equipment bought and serviced will be used locally for agriculture production. The criterion is <br />met. <br /> <br />(d) The products and services provided must be essential to the practice of agriculture. <br /> <br />The applicant’s proposal is to allow for the sale and repair of farm tractors and implements like Case IH, Case <br />CE, New Holland, JCB and Claas with hazelnut collecting tractors and machinery being suggested by the <br />applicant. The applicant provided information from a local tractor service and repair website that indicates that <br />they sell agricultural and construction equipment. In addition, they have a parts department, rental equipment and <br />offer repair services. A check of this company’s inventory indicates a wide variety of farm implements such as <br />conditioners, scrapers, sprayers, balers, flail mowers, disks, and a variety of other components. They also sell <br />smaller personal tractors such as zero turn rider mowers and mini skid steers. Their line of full sized tractors <br />includes combines, wheel loaders, skip loaders, and backhoes. This is in addition to a variety of farm tractors of <br />various sizes and capacities with bucket loaders and other attachments. The criterion is met. <br /> <br />8. In addition to the specific criteria above, the proposal must also satisfy the conditional use criteria in MCC <br />17.136.060(A). Those requirements are: <br /> <br />1. The use will not force a significant change in, or significantly increase the cost of accepted farm or forest <br />practices on surrounding lands devoted to farm or forest use. Land devoted to farm or forest use does not include <br />farm or forest use on lots or parcels upon which a non-farm or non-forest dwelling has been approved and <br />established, in exception areas approved under ORS 197.732, or in an acknowledged urban growth boundary. <br /> <br />For purposes of this section, a determination of forcing a significant change in accepted farm or forest practices <br />on surrounding lands devoted to farm and forest use or a determination of whether the use will significantly
