At the time Applicant purchased the property, it was in timber use, and Applicant planted <br />timber to replace the timber harvested by the prior owner. The subject property has historically <br />been in timber production, has never been in farm use, and continues to be managed for timber <br />production. <br />The proposed zone change is consistent with the historic and ongoing use of the property. <br />Applicant has established compliance with all applicable criteria, and the hearings officer <br />recommends APPROVAL of the application. <br />V. Findings of Fact <br />The Hearings Officer, after careful consideration of the testimony and evidence in the <br />record, issues the following finding of fact: <br />1. The subject property consists of one parcel, totaling 21.67 acres. The property is <br />designated Primary Agriculture in the Marion County Comprehensive Plan (MCCP) and <br />zoned EFU (Exclusive Farm Use). <br />2. The property is located at the terminus of Wagner Ln SE, a public road that is graveled. <br />The property is vacant and planted with commercial timber. There are no streams, <br />floodplains, wetlands or geo-hazards mapped on the subject property. <br />3. Surrounding properties to the west, and south are zoned EFU and in various types of farm <br />use. Property to the north and east are zoned TC (Timber Conservation) and are in active <br />timber use. <br />4. Applicant seeks to change the Comprehensive Plan designation from Primary Agriculture <br />to Farm Timber and change the zoning from EFU to FT (Farm Timber). <br />5. Marion County Planning Division requested comments from various governmental <br />agencies. The following comments were received: <br />Marion County Public Works Land Development and Engineering Permits (LDEP) <br />commented: <br />ENGINEERING REQUIREMENTS <br />A. At the time of application for building permits, an Access Permit will be required. <br />B. Transportation System Development Charges (TSDCs) and Parks fee will be <br />assessed at the time of application for building permits. <br />C. Any new utility service extensions such as electric power originating from within <br />the public right-of-way to the property require permits from MCPW Engineering. <br />Marion County Septic commented: "A soils and site evaluation will be required before <br />building." <br />ZC / CP / AR 25-001 — RECOMMENDATION <br />Jerome P.
