WETI~kND I~%ND USE NOTIFICATION PROCESS <br />Division of State Lands Wetlands Program <br /> <br />Under Senate Bill 3, cities and counties have a responsibility <br />to notify DSL of certain development activities proposed within <br />wetlands on National Wetlands Inventory (NWI) mapS. The <br />specific activities requiring notification are listed in ORS <br />215.418 (counties) and ORS 227.350 (cities). The purpose is to <br />improve local-state coordination and provide notification of <br />wetland regulations to landowners and applicants. Once the <br />local government has received its NWI maps from DSL, it should <br />follow these steps each time a listed land use application is <br />received: <br /> <br />1. Examine the wetland maps and determine if the project would <br />occur within a mapped wetland. <br /> <br />2. If it appears that a wetland might be affected, fill out a <br />Wetland LaJ1Q~_U~D__~f~_~t~_O_~k_~ (supplied by DSL) and mail it <br />to DSL with the attachments requested on the form. (Me sure the <br />site is clearly marked on tt]e NWl map pl]ot0copy attachment.) <br />Tt]is form must be sent within 5 days ~f receiving the completed <br />application. <br /> <br />3. Inform the applicant that the site may include jurisdictional <br />wetlands and a permit may be required by state and/or federal <br />agencies. DSL has 30 days in which to respond to the local <br />government, the landowner, and the applicant. ¥o~ are not <br />required to notify the applicant of DSL*s decision. <br /> <br />4. After notifying DSL, finish processing the application. You <br />may issue your final decision regardless of whether or not DSL <br />has responded. If DSL has failed to respond, you can approve <br />the activity with no liability on your part if you inform the <br />applicant that a state or federal permit may still be required. <br />The following (or similar) statement should be included in your <br />written approval: <br /> <br />All or a portion of this property has been identified as wetland on the <br />state~wide wetlande invento~y. If the site is a jurisdictional wetland, this <br />proposal may require a permit from the Division of State Lands and/or the <br />Army Corps of Engineer~. You must obtain any necessary state or federal <br />permits before beginning your project. The (City/County) of <br />A~sville/ Marion County Building is,notliable for aay delays in the <br />processing of a state or federal <br /> <br />Of course, if you deny the applicafion, neither DSL nor the <br />Corps of Engineers will approve the project. <br /> <br /> <br />
