BEFORE THE MARION COUNTY HEARINGS OFFICER <br />In the Matter of the Application of: <br />MKI CONSTRUCTION, LLC <br />Case No. CU 24-043 <br />CONDITIONAL USE <br />ORDER <br />I. Nature of the Application <br />This matter comes before the Marion County Hearings Officer on the Application of MKI <br />Construction , LLC to establish a non -farm dwelling on a 8.4 acre parcel in the EFU (Exclusive Farm Use) zone <br />located in the 14400 block of Union School Road NE, Woodburn (T5 S, R 1 W, Section 21, Tax Lot 200). <br />II. Relevant Criteria <br />Standards and criteria relevant to this Application are found in the Marion County Code, Title <br />17, especially Chapter 17.119 (Conditional Use) and Chapter 17.136 (Exclusive Farm Use). <br />III. Public Hearing <br />A public hearing was held on this matter on March 6, 2025. The Planning Division file was <br />made part of the record. Bowman Holt <br />4. <br />Don Holt <br />5. <br />Patricia Hitz <br />6. <br />Bernhard Hitz <br />Marion County Planning <br />Attorney for Applicant <br />Opponent <br />Opponent <br />Opponent <br />Opponent <br />In addition to the Planning Division File, prior to the hearings, the following submission was <br />received and included in the record: <br />Submission of Marjorie Campbell dated February 28, 2025, and received on March 4, 2025. <br />Ms. Campbell challenged the basis for a hearing and states that the EFU is in place to protect <br />from development and indicates that her property cannot be divided. <br />There were no objections to notice, conflict of interest, or jurisdiction. <br />The following documents were offered and entered into the record as exhibits without <br />objection: <br />Exhibit 1: Written Testimony of Nancy J.
