FINDINGS AND CONCLUSIONS: Findings and conclusions on which the decision was based are noted below. <br /> <br />l. The property is designated Rural Residential and Primary Agriculture in the Marion County Comprehensive <br />Plan. The purpose of this designation and the corresponding AR (Acreage Residential) zone is to allow creation <br />of acreage homesites at a density that maintains the character and environmental quality of rural residential areas <br />and the EFU zone promotes commercial farming operations. <br /> <br />2. The subject parcel is located on the north side of Meadows Ln SE, which is a dead-end non-county road that <br />branches off Sunnyside Rd SE near the I-5 interchange with Hwy 164. The property contains a 1991 dwelling and <br />two accessory structures. The subject parcel was originally created as Lot 5 of the Valley Meadows subdivision <br />on June 28, 1971 and has not changed its configuration since. Therefore, the parcel is legal for land use purposes. <br /> <br />3. Surrounding uses are a mix of large acreage residences to the east and west and large resource parcels containing <br />deciduous forested area, grazing land, and row crop fields. Other notable features in the area include the I5 right- <br />of-way 1700 feet to the east of the subject parcel and Ankeny Wildlife Refuge 1 mile to the west. <br /> <br />4. The applicant proposes to divide a 5.0-acre parcel into two new parcels of 2.50-acres and 2.50-acres. The <br />applicant intends to partition in such a way that both resultant parcels have frontage on Meadows Ln. <br /> <br />5. Various agencies were contacted about the proposal and given an opportunity to comment. <br /> <br />Marion County Survey Department commented: <br /> <br />1) Parcels must be surveyed and monumented <br />2) Per ORS 92.050, plat must be submitted for review <br />3) Checking fee and recording fees required <br />4) A current or updated title report must be submitted at the time of review. Title reports shall be no <br />more than 15 days old at the time of approval of the plat by the Surveyor’s Office, which may require <br />additional updated reports. <br /> <br />Marion County Septic commented: “The parcel with the existing house and septic requires an Existing System <br />Evaluation. The parcel without an existing house will need a Site Evaluation.” <br /> <br />Marion County Building commented: “No Building Inspection concerns. Permit(s) are required to be obtained <br />prior to development and/or utilities installation on private property.” <br /> <br />Public Works Land Development and Engineering Permits (LDEP) requested that the following be included in the <br />land use decision. <br /> <br />ENGINEERING CONDITIONS <br /> <br />Condition A – Prior to partition plat approval, under an Access Permit widen the proposed shared easement <br />driveway approach for a minimum of distance of 20 feet back from the public road, and clear sight obscuring <br />brush. <br /> <br />Condition B – Prior to partition plat approval, notarize a Road Maintenance Agreement to be recorded <br />concurrently with the partition plat for collective maintenance of the proposed private drive. <br /> <br />ENGINEERING REQUIREMENTS <br /> <br />C. The existing access approach to Meadows Lane shall be shared between the parcels. <br /> <br />D. Depict an access and utility easement on the partition plat over the south parcel, serving the north parcel. <br /> <br /> <br />
