4. Various Agencies were contacted with a request for comments. <br />Marion County Land Development Engineering and Permits (LDEP) commented: <br />ENGINEERING REQUIREMENT <br />A. Drainage conveyance improvements over county lands primarily serving development within City limits shall <br />be contained within public drainage easements dedicated to the City. <br />ENGINEERING ADVISORIES <br />B. The County will not maintain the drainageway primarily serving City development. <br />C. MCPW Engineering does not have permitting jurisdiction over the proposed drainage ditch. The City is <br />responsible for ensuring the conveyance ditch system is sufficient to meet City requirements. <br />D. DEQ regulates ground disturbances equal to or greater than 1.0 acre through the NPDES 1200-C Construction <br />Stormwater Erosion Program. <br />Marion County Building Inspection commented: No building Inspection concerns as it doesn't appear the proposed <br />work will affect any adjacent structures regulated by the state building code. <br />All other agencies either stated no comment or did not respond. <br />5. The purpose of the Floodplain Overlay Zone is to promote public health, safety and general welfare to minimize <br />public and private losses due to flood conditions. In order to ensure that the development is reasonably safe from <br />flooding, the County requires the development comply with the criteria and standards listed in Section 16.19.130 <br />and 16.19.140 of Marion County Code (MCC). <br />6. The development area is on the boundary between Marion County Flood Insurance Rate Maps #41047C704G and <br />#41047C708G. These FIRMs indicate the development area is in an AE zone. Based on FIRM panel <br />#41047C708G, and the corresponding Flood Insurance Study, Marion County staff determined the BFE of the <br />development area is 421.8 feet (NVGD29). <br />7. Marion County Code 16.19.130 requires prior to any development in the floodplain: <br />C. Prior to obtaining a building permit the owner shall be required to sign and record in the deed records for the <br />county a declaratory statement binding the landowner, and the landowner's successors in interest, acknowledging <br />that the property and the approved development are located in a floodplain. <br />The improved ditch is being placed in a easement for the developer until completion, at which time the easement <br />will be conveyed to the City of Stayton. The developer of the easement will be required to record a declaratory <br />statement referencing the recording information for the easement as a condition of approval. <br />D. Prior to obtaining a building permit, commencing development or placing frl in the floodplain the applicant <br />shall submit a certification from a registered civil engineer demonstrating that a development or fill will not <br />result in an increase in floodplain area on other properties and will not result in an increase in erosive velocity of <br />the stream that may cause channel scouring or reduce slope stability downstream of the development or fill. <br />The applicant provided engineer certification from Registered Professional Engineer Mark Grenz of Multi -Tech <br />Engineering Service, INC that the development will not result in any increase in floodplain area on other <br />properties and will not result in an increase in erosive velocity of the stream that could cause channel scouring or <br />reduce slope stability downstream. The criterion is met. <br />Additionally, MCC 16.19.140 provides standards for development in a floodplain: <br />D. Anchoring <br />1. All new construction and substantial improvements shall be anchored to prevent flotation, collapse or <br />lateral movement of the structure resulting from hydrodynamic and hydrostatic loads, including the <br />effects of buoyancy. <br />
