10. Exterior lighting shall be designed to illuminate the site and be directed away from public streets and residential <br />properties. <br /> <br />11. The property entrances shall meet Woodburn Fire Department standards. <br /> <br />12. The development shall significantly conform to the site plan submitted with the proposal. Minor variations are <br />permitted upon review and approval by the Planning Director. <br /> <br />13. Failure to continuously comply with the conditions of approval may result in this approval being revoked. Any <br />revocation could be appealed to a Marion County hearings officer for a public hearing. <br /> <br />OTHER PERMITS, FEES AND RESTRICTIONS: This approval does not remove or affect covenants or restrictions <br />imposed on the subject property by deed or other instrument. The proposed use may require permits and/or fees from other <br />local, State or Federal agencies. This decision does not take the place of, or relieve the responsibility for, obtaining other <br />permits or satisfying any restrictions or conditions thereon. It is recommended that the agencies mentioned in Finding #5 <br />under Findings and Conclusions below be contacted to identify restrictions or necessary permits. The applicant is advised <br />of the following: <br /> <br />14. The applicants should contact the Woodburn Fire District to obtain a copy of the District’s Recommended <br />Building Access and Premise Identification regulations and the Marion County Fire Code Applications Guide. <br />Fire District access standards may be more restrictive than County standards. <br /> <br />15. The applicants should contact Marion County Land Development and Engineering (503-584-7714) for <br />additional Engineering Requirements and Advisories, listed in Finding #5 below, that may be required. <br /> <br />APPEAL PROCEDURE: The Marion County Zone Code provides that certain applications be considered first by the <br />County Zoning Administrator. If there is any doubt that the application conforms with adopted land use policies and regula- <br />tions the Zoning Administrator must condition or deny the application. Anyone who disagrees with the decision may request <br />that the application be considered by a County hearings officer after a public hearing. The applicant may also request <br />reconsideration (one time only and a fee of $250) on the basis of new information subject to signing an extension of the <br />120-day time limit for review of zoning applications. <br /> <br />A public hearing is held on appeals subject to the appellant paying a $250.00 fee. Requests for reconsideration, or consider- <br />ation by a hearings officer, must be in writing (form available from the Planning Division) and received in the Planning <br />Division, 5155 Silverton Rd. NE, Salem, by 5:00 p.m. on February 21st, 2025. If you have questions about this decision <br />contact the Planning Division at (503) 588-5038 or at the office. This decision is effective February 24th, 2025, unless <br />further consideration is requested. <br /> <br />FINDINGS AND CONCLUSIONS: Findings and conclusions on which the decision was based are noted below. <br /> <br />l. The subject is a 0.72-acre parcel within the Woodburn urban growth boundary (UGB) and is designated Commercial <br />in the Woodburn Comprehensive Plan and is zoned Commercial General in Marion County. The purpose of this <br />designation and the corresponding Commercial General zone is to provide areas suitable for warehousing, wholesale <br />commercial sales and services with related outdoor storage or retail sales.The commercial general zone is <br />appropriate in those areas designated commercial in the applicable urban area comprehensive plan where the <br />location has access to an arterial street or highway for transport of bulk materials and where impacts associated with <br />permitted uses will not create significant adverse impacts on local streets or residential zones. <br /> <br />2. The subject property is on the west side of South Pacific Highway (Highway 99E), approximately 0.35 miles south <br />of its intersection with East Cleveland Street. The parcel contains a dwelling and was the subject of two land use <br />cases one in 1988 (V88-018), and in 1998 (ZC/CP98-013). The parcel is considered legal for land use purposes. <br /> <br />3. Properties to the north and west are within the City of Woodburn and are slated for medium density residential <br />development. To the south the zone is a split Marion County zone: Commercial Retail (CR)/Urban Transition 20 <br />(UT-20). Immediately south of the applicants the land zoned Commercial Retail Limited Use (CR-LU).
