NOTICE OF DECISION <br />CONDITIONAL USE CASE NO. (CU)79-64 <br /> <br />Notice is hereby given that the Planning Director for Marion County has APPROVED the <br />following described conditional use application subject to certain conditibns. The <br />findings and conclusions on which the Director based his decision are noted below. <br /> <br />APPLICATION: Application of Pete R. amd M. Bernadine Ward to locate a second non- <br />farm dwelling as a temporary hardship in an EFU (Exclusive Farm Use) zone on property <br />located at 1981101mstead Road NE (Sec. 19, T4S, R1W). <br /> <br />FINDINGS AND CONCLUSIONS: Approval was based upon the following findings and con- <br />clusions: <br /> <br />In October, 1979, the applicant applied for a permit to locate a second farm <br />related dwelling on the subject property. Due to several factors involving the <br />amount of time the second occupant would devote to the farm operations the <br />k~plica~ion was denied by the Marion County Building Department. <br /> <br />Subsequently, the applicant chose to apply for the temporary location of a <br />mobile home as a hardship. This approval would allow the mobile home to remain <br />on the property as long as evidence of continued hardship is provided to the <br />Planning Director on an annual basis, <br /> <br />3. A physician's certificate has been provided evidencing the fact that Mr. Ward <br /> has a heart condition and does need assistance with the farm operation. <br /> <br />CONCLUSION: Adequate evidence has been submitted to the Planning Staff to support <br />the proposal. Therefore, it.is the Staff's finding that the conditions for approval <br />have been shown to exist and the application is in conformance with Sections 136.230(a) <br />and llq.100(b) of the Marion County Zoning Ordinance. <br /> <br />CONDITIONS: Conditions of approval: <br /> <br />The applicants shall obtain approval for subsurface sewage disposal connection <br />or installation and obtain all other required permits from the Department of <br />Building Inspection. <br /> <br />The applicants shall sign and file with the Planning Department a removal <br />agreement verifying that the mobile home w~ll be removed within 60 days after <br />the expiration of the permit 'or the expiration of any extension thereof. <br /> <br />The applicants submit, on an annual basis, evidence that continual hardship <br />exists. <br /> <br />PROCEDURE: The Marion County Zoning Ordinance provides that conditional use appli- <br />cations be considered first by the County Plarn~ing Director. If the Planning Dir- <br />ector is satisfied that the application clearly conforms with all Marion County land <br />use policies and regulations he approves the application, Otherwise, the Director <br />must deny the application. Any interested person may appeal the Director's decision. <br />The appeal must be in writing and be received in the Marion County Planning Departments <br />220 High Street NE, Salem by ~/~.:,~ Ii~, 'I.~Tq ~ k public hearing is <br />held on appeals, The Rearings O~fieer'-consid~j the application on the basis of the <br />evidence presented at the hearing.
