the property owners, as well as in the decision, the easement serving this property has been in place <br />for many years and predates the ownership of most, if not all of the neighbors that currently live <br />in the area. The topography of this area is challenging, and this easement was established long ago, <br />as it is the most practical way to access this particular parcel of land. All other potential access <br />points are prohibitively steep and cannot feasibly serve a residence or provide emergency access. <br />The property owners in this case want to continue to be good neighbors and to work to <br />implement solutions to improve this access for the neighbors on Little Haven Lane today, and into <br />the future. The property owners are aware that Measure 37/49 development rights exist on nearby <br />property and that additional dwellings could potentially be developed at any time. The property <br />owners do not oppose plans to implement those development rights and would welcome the <br />opportunity to work with the neighboring landowner to ensure access rights are sufficient to <br />support any planned development. In fact, the property owners in this case have offered to sign a <br />nonremonstrance agreement or similar commitment not to oppose development these additional <br />single-family dwellings. <br />The property owners have attempted at every step to approach this the right way. The <br />application was filed back in February and they have patiently waited for this process to play out, <br />providing an extension of time to review the decision, even as the building season passes by. As <br />noted above, this is an issue that is squarely within the authority of the Board to decide. For all of <br />the reasons previously identified, the property owners respectfully request that the Board of <br />Commissioners accept its appeal to review and reconsider the interpretation of MCC 17.110.800 <br />rendered by the Hearings Officer and to adopt an interpretation of the County's Zoning Code that <br />reinstates the prior interpretation as applied by the Planning Department. <br />Enclosure(s) 1 — letter from property owners <br />cc: Client by email only <br />John Speckman, Marion County Planning Department by email only <br />Page 3 of 3 — Letter to Marion County Board of County Commissioners <br />
