The property owners have
been working with the County's Planning Department over the last year to obtain the necessary
approvals to implement their plan and have attempted to engage with their neighbors during this
time to address any questions or concerns that individuals might have about the proposal. After an
appeal by some of the neighbors of the Planning Department's initial approval of the application,
the County's Hearings Officer found that the proposal met all of the criteria for a conditional use
to establish a non -farm dwelling on their property with the exception of a generally applicable
development criteria that limits the number of dwellings that can utilize a private drive. The
applicant and property owners respectfully request that the Board of County Commissioners accept
its appeal to review and reconsider the interpretation of MCC 17.110.800 by the Hearings Officer.
We thank you in advance for your time and thoughtful consideration of this request, which would
allow the property owners to develop their property consistent with all other requirements of
County Code.
The property owner is appealing the decision in this case for the limited purpose of reviewing
the Hearings Officer's interpretation of MCC 17.110.800, Besides this single criterion, the
property owners agree fully with the remainder of the County Hearings Officer's decision. A
separate letter has been provided to you from the property owners, a copy of which enclosed with
this letter, that details some of the relevant background and history related to the family's
ownership of the property. The property owners understand and respect that generally applicable
zoning controls are fundamental regulations that are intended to minimize potential conflicts
Page 1 of 3 — Letter to Marion County Board of County Commissioners
