BEFORE THE BOARD OF COMMISSIONERS <br />FOR MARION COUNTY, OREGON <br />In the Matter of the Application of: ) Case No. CU24-006 <br />JOY BLACKMAN REVOCABLE TRUST 1 CONDITIONAL USE <br />ORDER NO. 2! - / / to <br />This matter comes before the Marion County Board of Commissioners ("Board") on the <br />application of the Joy Blackman Revocable Living Trust for a Conditional Use to establish a non -farm <br />dwelling on a 5.97-acre parcel in the SA (Special Agriculture) zone located in the 3300 block of Little <br />Haven Lane S, Salem (T8S; R3W; Section 713; Tax lot 800). <br />The Marion County Hearings Officer held a duly noticed public hearing on this application on May 2, <br />2024, and issued a decision denying the proposal on July 30, 2024. The Hearings Officer's decision was <br />appealed to the Board on August 14, 2024. The Board held a public hearing to consider the appeal, <br />application, and findings on October 16, 2024. The Board closed the public hearing the same day and left <br />the record open until October 30, 2024. A motion to approve the appeal was made during a Board session <br />on November 6, 2024. <br />IT IS HEREBY ORDERED that the appeal is APPROVED, the Board overturns the Hearings Officer's <br />decision on this matter, and adopts its own Findings of Fact which is attached as Exhibit A, subject to <br />conditions attached as Exhibit B. <br />DATED this day of !J-CeyKL5er 2024, at Salem, Oregon. <br />MARION COUNTY BOARD OF COMMISSIONERS <br />Commissioner <br />JUDICIAL NOTICE <br />Oregon Revised Statutes, Chapter 197.830, provides that land use decisions may be reviewed by the Land <br />Use Board of Appeals by filing a notice of intent to appeal within 21 days from the date this Ordinance <br />becomes final. <br />
