the site of this home occupation. Christmas trees are being produces on approximately 0.35-acres of the <br />southernmost portion of this property. <br /> <br />3. The subject parcel is surrounded on all sides by hazelnut orchards. On the other side of the west-adjacent hazelnut <br />orchard is a residential subdivision within the City of Salem. Southeast across Cordon Rd are other rural <br />residences and hazelnut orchards. Other agricultural uses in the general area include grass seed and row crops. A <br />quarter mile to the north is the E.Z. Orchards Farm Market. <br /> <br />4. Soil Survey of Marion County Oregon indicates 100% of the subject property is composed of high-value farm <br />soils. <br /> <br />5. Marion County Planning requested comments from other government agencies. <br /> <br /> Marion County Building Inspection commented: “According to the information provided within the application, <br />the proposed business is not proposed to be opened to the public. No Building Inspection concerns with <br />proposal.” <br /> <br />Marion County Septic commented: “An authorization is required since there is a change of use occurring on the <br />property.” <br /> <br />All other commenting agencies either failed to respond or stated no objection to the proposal. <br /> <br />6. Since the property is located in an EFU zone, the proposal must satisfy the conditional use criteria in MCC <br />17.136.060(A). Those requirements are: <br /> <br />(a) The use will not force a significant change in, or significantly increase the cost of, accepted farm or forest <br />practices on surrounding lands devoted to farm or forest use. Land devoted to farm or forest use does not <br />include farm or forest use on lots or parcels upon which a non-farm or non-forest dwelling has been <br />approved and established, in exception areas approved under ORS 197.732, or in an acknowledged <br />urban growth boundary. <br /> <br />The proposed home occupation will involve the storage of vehicles for sale within an accessory structure <br />on the subject parcel. The business will not be open to the public, nor will it involve customers travelling <br />to the subject parcel. The applicant attests that all sales will occur offsite. The maximum number of <br />vehicles the applicant proposes storing at any given time is three. The traffic resulting from trips to bring <br />newly acquired vehicles to the property, and leaving the property to meet up with prospective buyers is <br />the only anticipated impact as a result of the proposed home occupation. An operation limited to three <br />vehicles at a time is unlikely to significantly increase traffic in the area as a result of these activities. <br />Therefore, based on the information supplied by the applicant, this use will neither force a significant <br />change in, nor a significant cost of, accepted farm practices on surrounding lands. The criterion is met. <br /> <br />(b) Adequate fire protection and other rural services are, or will be, available when the use is established. <br /> <br />The subject parcel is served by Marion County No. 1 Fire District and the Marion County Sheriff's <br />Department. The property has a well and septic for the dwelling inhabited by the property owner and <br />proposed operator of the home occupation. Access to the parcel is accomplished via county roads within <br />public right-of-ways. All services required for storage of the vehicles will be within an existing accessory <br />structure. The criterion is met. <br /> <br />(c) The use will not have a significant adverse impact on watersheds, groundwater, fish and wildlife habitat, <br />soil and slope stability, air and water quality. <br /> <br />The most likely potential adverse impact on the watershed or groundwater would result from vehicles <br />leaking pollutants. The vehicles will be stored within an accessory structure so in the event of issues like
