Such requirements may include, but are not limited to: a building permit, <br /> a land use decision, a permit as defined in ORS 215. 402 or 227.160, other <br /> permits or authorization from local, state, or federal agencies, and restrictions on <br /> the use of the subject property imposed by private parties. <br /> If the claim were determined to be valid, obtaining all required permits can be made a <br /> condition of approval, and this criterion could be met. <br /> VII. Order <br /> It is hereby found that Applicant has NOT met his burden of proving the <br /> applicable standards and criteria for approval of the administrative review application to <br /> .determine whether a measure 49 Order remains valid on a 13.53 acre property <br /> consisting of two tax lots in an EFU (Exclusive Farm Use) zone located in the 14300 <br /> block of Evans Valley Road NE, Silverton (T6S, R1 W, Section 35D, tax lots 1400 and <br /> 1600). The Measure 49 Order, Election Number E133582, has expired, and the <br /> administrative review application is DENIED. <br /> VIII. Appeal Rights <br /> An appeal of this decision may be taken by anyone aggrieved or affected by this Order. <br /> An appeal must be filed with the Marion County Clerk (555 Court St. NE, Suite 2130, <br /> Salem, Oregon by 5:00 p.m. on the 31st day of May, 2022. The appeal must be in <br /> writing, must be filed in duplicate, must be accompanied by a payment of $500, and <br /> must state wherein this order fails to conform to the provisions of the applicable <br /> ordinance.
