following analysis goes through all of the applicable approval criteria and provides the <br /> required findings. <br /> A. Goal 3 Exception <br /> The applicant is seeking both a comprehensive plan amendment and a zone <br /> change. The zone change is dependent upon obtaining the comprehensive plan <br /> amendment. In other words, if the applicant fails to obtain a comprehensive plan <br /> amendment then it cannot obtain the proposed zone change. The property is designated <br /> Primary Agriculture, which means the property is agricultural land. Therefore, in order to <br /> change the plan and zone designation to allow for industrial use the applicant must obtain <br /> an exception to Goal 3. <br /> Under ORS 197.732(2), there are three types of goal exceptions that may be taken: <br /> physically developed, irrevocably committed, and reasons exceptions. The applicant is <br /> seeking an irrevocably committed exception. OAR 660-004-0028(1) provides that an <br /> irrevocably committed exception may be taken "when the land subject to the exception is <br /> irrevocably committed to uses not allowed by the applicable goal because existing <br /> adjacent uses and other relevant factors make uses allowed by the applicable goal <br /> impracticable[.]" OAR 660-004-0028(2) provides: <br /> "Whether land is irrevocably committed depends on the relationship between the <br /> exception area and the lands adjacent to it. The findings for a committed exception <br /> therefore must address the following: <br /> "(a) The characteristics of the exception area; <br /> "(b) The characteristics of the adjacent lands; <br /> "(c) The relationship between the exception area and the lands adjacent to <br /> it; and <br /> "(d) The other relevant factors set forth in OAR 660-004-0028(6)." <br /> OAR 660-004-0028(2)(a) requires a description of the characteristics of the <br /> proposed exception area. The proposed exception area is a 3-acre portion of a parcel of <br /> CP/ZC/PLA 21-001 -RECOMMENDATION-5 <br /> WING PROPERTIES,LLC <br />
