forwarded the property line adjustment to the hearings officer so that all three <br /> applications could be reviewed concurrently. MCC 17.172.120(A) is satisfied. <br /> MCC 17.172.120(B) provides that property in certain zones do not require <br /> approval for a property line adjustment. The EFU zone, however, is one of the zones that <br /> does require approval. The applicant accordingly filed this application for a property line <br /> adjustment. MCC 17.172.120(B) is satisfied. <br /> MCC 17.172.120(C) requires that certain property line adjustments must go <br /> through the partitioning procedure except as provided by MCC 17.172(A or B). The <br /> property line adjustment is being processed under the MCC 17.172.120(A) exception. <br /> MCC 17.172.120(C) is satisfied. <br /> MCC 17.172.120(D) requires that adjustment or removal of property lines <br /> involving a parcel in a recorded partition or a lot in a recorded subdivision must use the <br /> replat process of ORS 92.180-190. The applicant explains that the proposed property line <br /> adjustment includes the removal of two private property lines and the creation of one new <br /> property line; no removal of a public easement; and that the applicant will meet all the <br /> requirements specified for a property line adjustment under ORS 92.180-190. MCC <br /> 17.172.120(D) is satisfied. <br /> MCC 17.172.120(E) requires that property line adjustment deeds shall be recorded <br /> with the Marion County clerk's office prior to submitting the property line adjustment <br /> survey, if a survey is required. The proposed conditions of approval require the applicant <br /> to record the property line adjustment deeds before submitting the survey, which is <br /> required. MCC 17.172.120(E) is satisfied. <br /> MCC 17.172.120 is satisfied. <br /> As the property line adjustment involves land in an EFU zone, the applicant must <br /> also satisfy the requirements of MCC 17.136.090(C), which provides: <br /> "Property Line Adjustments. <br /> "I. When one or more lots or parcels subject to a proposed property line <br /> adjustment are larger than the minimum parcel size pursuant to subsection <br /> CP/ZC/PLA 21-001 -RECOMMENDATION-28 <br /> WING PROPERTIES,LLC <br />
