As currently proposed, each of the four lots will have a minimum of 127 feet of frontage along Happy Way SE. <br />As discussed in their comments, Marion County Land Development and Engineering would require that Happy <br />Way SE be improved to the above standards prior to plat approval. <br />DELIBERATION: <br />On June 15, the Planning Commission held a public hearing about the proposed subdivision. Deliberations primarily <br />pertained to the improvements required by Marion County Land Development and Engineering (LDEP) to the currently <br />unopened Happy Way SE. The applicant provided testimony pertaining to the conditions -of -approval and suggested <br />alternatives beyond the County's approach to resolve a site distance issue. The applicant also expressed concern about the <br />required 20 foot width of the right-of-way by pointing to the County's 16 foot standard for privately maintained gravel <br />roads. Commissioners discussed these various approaches and heard testimony from LDEP staff and the public. Three <br />members of the public attended and expressed confusion at the proposed lowering of Steiwer Road recommended by the <br />County to address the sight -distance issue that would arise from the opening of Happy Way SE. Commissioners <br />determined that the proposed conditions of approval would be reasonable so long as the County was willing to accept <br />maintenance responsibilities for Happy Way SE. The Commission resolved to close the public hearing but left the record <br />open in order for LDEP to seek guidance on accepting the right-of-way into the maintenance system. <br />DECISION: <br />At the July 13, 2021, meeting, after reviewing new testimony that the County was willing to accept Happy Way SE into <br />the maintenance system, a motion was made and seconded to grant conceptual and detailed approval to subdivide the <br />property into 4 lots subject to the recommended conditions of approval.
