The criteria for approving a conditional use in the ID zone are found in Chapter 17.150.160 of the Marion County <br />Code (MCC): <br /> <br />A. The use will not force a significant change in, or significantly increase the cost of, accepted farm or forest <br /> practices on surrounding lands devoted to farm or forest use; <br /> <br />Surrounding land is zoned ID. Nothing from the site would impact farmland in the area. This criterion is met. <br /> <br />B. The proposed use will not, by itself or in combination with existing uses in the community, result in public <br />health hazards or adverse environmental impacts that violate state or federal water quality regulations; <br /> <br />The proposed use would be consistent with other uses in the area serving the truck industry and would not, itself, <br />create a public health hazard or adverse environmental impacts that violate water quality regulations. The use will <br />increase traffic to the area by 22 trips a day, which is not a significant amount of traffic in the area that is already <br />heavily trafficked by trucks. In addition, water use on the site will be minimal, according to the applicant’s <br />statement. This criterion is met. <br /> <br />C. The proposed use will not, by itself or in combination with existing uses in the community, exceed the <br /> carrying capacity of the soil or of existing water supply resources and sewer services; <br /> <br />Water would be available to the site from a well and minimal water use is expected. Sewer service is provided by <br />the Brooks Community Sewer District for the business and employees at the site. This criterion is met. <br /> <br />D. The traffic generated by the proposed use is consistent with the identified function, capacity, and level of <br /> service of transportation facilities serving the community; and <br /> <br />Public Works Land Development and Engineering comments indicate that the roadway will be able to support the <br />additional trips if the applicant makes a proportional share contribution toward a future interstate ramp and local <br />road intersection improvements. This can be made a condition of any approval. <br /> <br />E. The proposed use will not create significant adverse effects on existing uses or permitted uses on adjacent <br /> land, considering such factors as noise, dust and odors. <br /> <br />While the use may generate additional noise, it would be consistent with and similar to existing noise in the area <br />from other uses serving the trucking industry. Additionally, other uses in the area generate significantly higher <br />amounts of traffic. No activity on this property is expected to adversely impact surrounding properties and uses. <br />Development will be required to meet the applicable standards of the ID zone (Chapter 17.150 MCC). This <br />criterion is met. <br /> <br />F. The proposed use is intended to directly serve the traveling public or trucking industry, or both. <br /> <br />No passenger vehicles are proposed to be serviced by the facility. The proposal is to provide tire repair service <br />only to large commercial trucks. This criterion is met. <br /> <br />7.
