Condition A - The proposed development would generate a significant amount of traffic that <br />would impact the transportation system in the area. This trip generation is in the range for <br />which a Transportation Impact Analysis (TIA) may be required. However, Marion County <br />staff has reviewed the area and the transportation impacts, and has identified mitigation <br />measures necessary for this development. If the developer provides the mitigation measures <br />included in the following Conditions, Marion County Public Works will not require <br />preparation of a TIA. <br />Condition B— Pursuant to Chapter 16.39.060(B)(10) of the Marion County Urban Zone Code, <br />the applicant will be required to dedicate sufficient right-of-way along the 45th Avenue NE <br />subject property frontage to provide the public dedicated right-of-way half -width necessary to <br />accommodate public improvements. Dedication shall be a 36 -foot half -width as specified for a <br />City of Salem Minor Arterial street standard to accommodate a minimum 12 -foot wide <br />center/left turn lane. Any dedications should be to the public, not Marion County. <br />Condition C — Improve the 45th Avenue NE subject property frontage in accordance with <br />appropriate standards as directed by Public Works, to include such elements as a 23 -foot paved <br />half -width to accommodate a travel lane, bike lane, and one-half center turn lane, curb and <br />gutter, property line sidewalk, closed -system drainage work, and landscaping over the entire <br />frontage. The developer will also need to provide a full left center turn lane at the site access <br />that will necessitate widening the east side of 45th Avenue pavement to maintain the existing <br />lane and shoulder widths. <br />Condition D — Provide the ability for vehicular connectivity from the subject property to tax <br />lot 072W07DC00700, addressed as Wellesley Park Apartments. <br />Condition E — Provide a sidewalk or other pedestrian connection from the proposed <br />development south to the existing sidewalk at the corner of 45th Avenue NE at Silverton Road <br />NE, a distance of approximately 350 feet. The applicant is also responsible for acquiring <br />necessary right-of-way half -width, or a public easement, to accommodate said pedestrian <br />connection along the 45th Avenue NE property frontage of tax lot 072W07DC01400, <br />addressed as 4455 Silverton Road NE. <br />(c) All current and future development on the property must satisfy the specific development <br />standards in the RM zone and the general development standards found in Chapters 26 through <br />40 of the MCC. <br />(d) Prior to any building permit approval, the applicant shall provide evidence that any required <br />permits or agreements have been filed with the City of Salem and that any required upgrades to <br />sewer or water service have been made to the City of Salem's satisfaction. <br />(e) Prior to development of the property, the applicant shall provide evidence that the <br />Marion County Fire District #1 has reviewed and approved all access and turnaround <br />improvements. <br />
