COMMENTS: <br />5. Information listed below may be a narrative summary of comments received from various <br />agencies. Complete written comments are available in the file. <br />Marion County Department of Public Works Land Development Engineering and Permits (LDEP) <br />requested the following conditions, lettered A through E, be included in the decision. LDEP also <br />commented on requirements that are not part of the land use decision and available for review in the <br />planning file. <br />Condition A - The proposed development would generate a significant amount of traffic that would <br />impact the transportation system in the area. This trip generation is in the range for which a <br />Transportation Impact Analysis (TIA) may be required. However, Marion County staff has reviewed <br />the area and the transportation impacts, and has identified mitigation measures necessary for this <br />development. If the developer provides the mitigation measures included in the following Conditions, <br />Marion County Public Works will not require preparation of a TIA. <br />Condition B— Pursuant to Chapter 16.39.060(B)(10) of the Marion County Urban Zone Code, the <br />applicant will be required to dedicate sufficient right-of-way along the 45th Avenue NE subject <br />property frontage to provide the public dedicated right-of-way half -width necessary to accommodate <br />public improvements. Dedication shall be a 36 foot half -width as specified for a City of Salem Minor <br />Arterial street standard to accommodate a minimum 12 foot wide center/left turn lane. Any <br />dedications should be to the public, not Marion County. <br />Condition C — Improve the 45th Avenue NE subject property frontage in accordance with appropriate <br />standards as directed by Public Works, to include such elements as a 23 foot paved half -width to <br />accommodate a travel lane, bike lane, and one-half center turn lane, curb and gutter, property line <br />sidewalk, closed -system drainage work, and landscaping over the entire frontage. The developer will <br />also need to provide a full left center turn lane at the site access that will necessitate widening the east <br />side of 45th Avenue pavement to maintain the existing lane and shoulder widths. <br />Condition D — Provide the ability for vehicular connectivity from the subject property to tax lot <br />072W07DC00700, addressed as Wellesley Park Apartments. <br />Condition E — Provide a sidewalk or other pedestrian connection from the proposed development <br />south to the existing sidewalk at the corner of 45th Avenue NE at Silverton Road NE, a distance of <br />approximately 350 feet. The applicant is also responsible for acquiring necessary right-of-way half, <br />width, or a public easement, to accommodate said pedestrian connection along the 45th Avenue NE <br />property frontage of tax lot 072W07DC01400, addressed as 4455 Silverton Road NE. <br />Salem-Keizer Public Schools provided information concerning possible impacts to the District <br />resulting from the proposal. <br />Marion County Building Inspection stated that building permits are required for any new construction. <br />STAFF FINDINGS AND ANALYSIS: <br />6.
