drainage to Marion County standards along the subject property frontage on 45th Avenue NE at <br />a more appropriate date. <br />The Public Improvement Agreement will require the applicant and/or their heirs, successors <br />and assigns, to participate financially to a level proportional to the costs of their frontage <br />improvements at the time a County project or County -approved third party project is developed <br />that would include the subject property frontage. A recordable agreement will be provided by <br />Marion County Public Works. <br />In lieu of entering into a Public Improvement Agreement as described above, the applicant has <br />the following option: <br />Optional Condition A — Improve the 45th Avenue NE subject property frontage <br />(approximately 90 feet plus required tapers and transitions) to current County and City of <br />Salem standards for an urban Collector road prior to plat approval. To ensure the appropriate <br />design parameters, this will require that the applicant provide Marion County Public Works an <br />acceptable engineering design that addresses the entire xxx-foot section between, and fully <br />incorporates the existing facilities located at, 3785-3815 45th Avenue NE to the north and <br />4420-4480 Seaton Lane to the south. <br />Urban improvements are to be constructed in accordance with appropriate standards as directed <br />by Public Works as a condition for final plat approval. This would include such elements as <br />pavement widening to accommodate the ultimate cross-section including travel lanes, half of a <br />two-way center left -turn lane, bike lanes, curb/gutter, property line sidewalk, closed system <br />drainage work, landscape strip, and any tapers or transitions required. Submission of <br />engineering plans to the County for review and approval will be required, as well as obtaining <br />the necessary construction permits. Applicant's engineer should contact Public Works for <br />scoping information prior to any design work. <br />Condition B - Show sufficient dedicated right-of-way (R/W) on the plat to provide the public <br />R/W half -width of 34 feet for an urban Collector road along the entire subject property 45th <br />Avenue NE frontage. <br />R/W dedication requirements for partitioning are in accordance with Section 33 of the Urban <br />Zone Code of Marion County. It appears that there is currently a deficiency in half -width. The <br />R/W dedication shall be shown as a 34 -foot half -width on the final plat. All dedications shall <br />be to the public, not Marion County. The nexus for this requirement is the proposed addition of <br />traffic, including pedestrians, which necessitate these minor roadway improvements. <br />4. The resulting parcels shall significantly conform to the site plan submitted with the proposal. <br />Minor variations are permitted upon review and approval of the Planning Director. All lots <br />must be a minimum of 6000 square feet. <br />ADDITIONAL CONDITIONS: Once the approved use is established the following conditions must <br />be continually satisfied: <br />After the final Partitioning plat has been recorded no alteration of property lines shall be <br />permitted without first obtaining approval from the Planning Director. <br />
