NOTICE OF DECISION CONDITIONAL USE CASE NO. 09-44 APPLICATION: Application of Keith and Nancy Walton for a conditional use to establish an adult day care facility business as a home occupation on a 4.75 acre parcel in a SA (SPECIAL AGRICULTURE) zone located at 555 Misty Hill Lane SE, Salem (T8S; R3W; Section 34C; tax lot 200). DECISION : Notice is hereby given that the Planning Director for Marion County has APPROVED the above described Conditional Use application subject to certain conditions. EXPIRATION DATE: This conditional use permit is valid only when exercised by SEPTEMBER 28, 2011. The effective period of an approved application may be extended for an additional year subject to approval of an extension (Extension form available from the Additional extensions may not be granted if the regulations under which Planning Division). this decision was granted have changed since the original approval. WARNING: A decision approving the proposed uses is for land use purposes only. Due to septic, well and drainfield replacement areas, this parcel may not be able to support the proposed activities. To be sure the subject property can accommodate the proposed use the applicant needs to check with the Building Inspection Division, (503) 588-5147. This decision does not include approval of a building permit. CONDITIONS: The following conditions must be met before a building permit can be obtained or the approved use established: 1. Within sixty days of the date of this decision becoming final, the applicants shall obtain any permits required by the Marion County Building Inspection Division. 2. Prior to the issuance of building permits, or establishing the use, the applicants shall address the Marion County Public Works provisions outlined in item #7 of the Findings and Conclusions section below. The requirements shall be met to the department’s satisfaction. 3. Any signage shall meet the standards in 191.060(A) for home occupations. 4. The home occupation is limited to a maximum of 10 participants at one time and no individual participant can remain at the site for more than 14 continuous days.
