<br />NOTICE TO MORTGAGEE, LIENHOLDER, VENDOR, OR SELLER: ORS CHAPTER <br />215 REQUIRES THAT IF YOU RECEIVE THIS NOTICE, IT MUST PROMPTLY BE <br />FORWARDED TO THE PURCHASER. <br /> <br /> <br />NOTICE OF DECISION <br />CONDITIONAL USE CASE NO. 09-44 <br /> <br /> <br />APPLICATION: <br />Application of Keith and Nancy Walton for a conditional use to establish an <br />adult day care facility business as a home occupation on a 4.75 acre parcel in a SA (SPECIAL <br />AGRICULTURE) zone located at 555 Misty Hill Lane SE, Salem (T8S; R3W; Section 34C; tax <br />lot 200). <br /> <br />DECISION <br />: Notice is hereby given that the Planning Director for Marion County has <br />APPROVED <br /> the above described Conditional Use application subject to certain conditions. <br /> <br /> <br />EXPIRATION DATE: <br /> This conditional use permit is valid only when exercised by <br />SEPTEMBER 28, 2011. <br /> The effective period of an approved application may be extended <br />for an additional year subject to approval of an extension (Extension form available from the <br />Additional extensions may not be granted if the regulations under which <br />Planning Division). <br />this decision was granted have changed since the original approval. <br /> <br /> <br />WARNING: <br /> A decision approving the proposed uses is for land use purposes only. Due to <br />septic, well and drainfield replacement areas, this parcel may not be able to support the proposed <br />activities. To be sure the subject property can accommodate the proposed use the applicant <br /> <br />needs to check with the Building Inspection Division, (503) 588-5147. <br /> <br />This decision does not include approval of a building permit. <br /> <br />CONDITIONS: <br /> The following conditions must be met before a building permit can be obtained <br />or the approved use established: <br /> <br />1. Within sixty days of the date of this decision becoming final, the applicants shall obtain <br />any permits required by the Marion County Building Inspection Division. <br /> <br />2. Prior to the issuance of building permits, or establishing the use, the applicants shall <br />address the Marion County Public Works provisions outlined in item #7 of the Findings <br />and Conclusions section below. The requirements shall be met to the department’s <br />satisfaction. <br /> <br /> <br />3. Any signage shall meet the standards in 191.060(A) for home occupations. <br /> <br />4. The home occupation is limited to a maximum of 10 participants at one time and no <br />individual participant can remain at the site for more than 14 continuous days. <br /> <br /> <br />
