<br />NOTICE TO MORTGAGEE, LIENHOLDER, VENDOR, OR SELLER: ORS CHAPTER 215 <br />REQUIRES THAT IF YOU RECEIVE THIS NOTICE, IT MUST PROMPTLY BE FORWARDED TO <br />THE PURCHASER. <br /> <br />NOTICE OF DECISION <br />PROPERTY LINE ADJUSTMENT CASE NO. 09-14 <br /> <br />APPLICATION: <br /> Application of Lonnie and Bertha McFarland to adjust the property lines on a 0.48 acre <br />parcel and a 1.02 acre parcel to create a 0.78 acre parcel and a 0.72 acre parcel in a UT-5 (Urban Transition – 5 <br />acre density) zone located at 4900 and 4912 Silverton Road NE, Salem. (T7S; R2W; Section 17BA; tax lots <br />500 and 600). <br /> <br />DECISIONAPPROVED <br />: Notice is hereby given that the Planning Director for Marion County has the above <br />listed Property Line Adjustment application subject to certain conditions. <br /> <br />EXPIRATION DATE: <br /> Title transfer instruments accomplishing the property adjustments shall be recorded <br /> August 3, 2011 <br />by the applicants with the Marion County Clerk by. The effective period of an approved <br />application may be extended for an additional year subject to approval of an extension (Extension form <br />Additional extensions may not be granted if the regulations under <br />available from the Planning Division). <br />which this decision was granted have changed since the original approval. <br /> <br /> <br />WARNING: <br /> A decision approving the proposed uses is for land use purposes only. Due to septic, well and <br />drainfield replacement areas, this parcel may not be able to support the proposed activities. To be sure the <br />subject property can accommodate the proposed use the applicant needs to check with the Building Inspection <br />Division, (503) 588-5147. <br /> <br />This decision does not include approval of a building permit. <br /> <br /> <br />CONDITIONS: <br /> The following conditions must be met before a building permit can be obtained or the <br />approved use established: <br /> <br />1. The applicants shall have the new property line surveyed and monumented. The survey shall be filed <br />with the County Surveyor and shall contain the notation that the survey is the result of Property Line <br />Adjustment Case 07-33. <br /> <br />2. Prior to recording the deeds, the applicants shall obtain any septic review and/or evaluations that may be <br />required from the Marion County Building Inspection Division. (503) 588-5147. <br /> <br />3. Property line adjustment deeds, meeting requirements identified in ORS 92.190(4) shall be recorded <br />with the County Clerk. The deeds shall include a perimeter description of both adjusted parcels. <br /> <br />4. An access easement shall be recorded across tax lot 600 for the benefit of tax lot 500. Easements <br />located within the Urban Growth Boundary shall be a minimum of 25 feet in width and have a minimum <br />12-foot wide paved surface. <br /> <br />5. Prior to recording the survey or deeds, the applicants shall address the Marion County Public Works <br />provisions outlined in finding #5 below. The requirements shall be met to the department’s satisfaction. <br /> <br />6. The resulting parcels shall substantially conform to the site plan in the file. Minor variations are <br />permitted upon review and approval of the Planning Manager. <br /> <br /> <br />
