<br />VIOLATIONS <br /> <br />8. Marion County Ordinance No. 1230, Section 22 outlines procedures for violations of this <br />ordinance: <br /> <br />Section 22: Public Nuisance and Violations. <br /> <br />Except as provided in subsection (2) of this section, violation of any provision of this ordinance or the <br />erection or construction of a permanent physical alteration to the real property that is the site of the <br />outdoor mass gathering shall constitute a Class A violation as provided in ORS Chapter 153. <br /> <br />Any violation of Section 4(1) of this ordinance is punishable upon conviction by a fine of not more than <br />$10,000.00 as provided for in ORS 433.990 (2005). <br /> <br />Enforcement shall be accomplished through the Marion County Enforcement Ordinance. <br /> <br />CONCLUSION <br /> <br />9. Based on the above findings, the Planning Director recommends approval of this application. <br /> <br />RECOMMENDED CONDITIONS OF APPROVAL <br /> <br />10. If the Board of Commissioners chooses to approve this application, the Planning Director <br />recommends including the following conditions of approval: <br /> <br /> Marion County Public Works: <br />a. Applicant shall delineate the Mt. Angel Hwy entrance onto 6118 Mt. Angel Hwy NE by <br />striping the edges of the access at a width of 20 feet. The existing usable width is <br />approximately 17 feet. An additional 3 feet of width shall be provided on the north side of <br />the existing access. This delineation shall extend from Mt. Angel Hwy for a distance of at <br />least 100 feet onto the property. The stripe shall be white and shall be at least 4 inches <br />wide. The marking material may be lime or other non-permanent material for marking non- <br />hard surface areas. <br /> <br />Applicant shall confer with MCPW Traffic Engineering Section on sign size details and <br />placement for those signs related to event traffic. No signs shall be placed in a manner that <br />creates a sight distance obstruction or impedes traffic. A sign plan shall be submitted to <br />MCPW for review at least 7 days before the event. <br /> <br />Applicant shall supply contact information for flaggers that will be on call to be used to <br />control traffic on Marion County right of way if necessary. Permission is not granted to <br />institute traffic control at the applicant’s discretion. Permission must be obtained from <br />MCPW Traffic Engineering Section prior to instituting traffic control. <br /> <br />Applicant shall contact MCPW Traffic Engineering Section, Bill Brownlee at 503-588- <br />5036 during the week between July 20 and July 24 to review how the Traffic Control Plan <br />is working. Marion County reserves the right to modify or amend the Traffic Control Plan <br />as necessary. <br /> <br /> 10 <br /> <br />
