to allow a dwelling under the current EFU zone, the Board must not apply the following <br />regulations: MCRZO sections 136.010; 136.030 (a); 136.050 (a) except 136.070; 136.060 (a) and <br />(b) and MCCP Agricultural Lands Policies 2, 3, 4, and 5. However, the applicant is advised that <br />removal of regulations back to April 4, 1983, may not provide the ability to place a dwelling on the <br />subject property as proposed. <br /> <br />13. The EFU zone is regulated through Oregon Revised Statute 215.283 and Oregon Administrative <br />Rule 660. Applicants are advised that approval from the State of Oregon for the same use is also <br />required before the use can be allowed. <br /> <br />14. If state and local regulations are not applied the applicant must still apply for a farm or non-farm <br />dwelling. The request will be reviewed based on current regulations and development standards <br />exempt under M37, regulations not waived by the Marion County Board of Commissioners or the <br />State of Oregon, and those under the EFU zone in effect on April 4, 1983. <br /> <br />RECOMMENDATION <br /> <br />15.
