This decision is <br />effective OCTOBER 20, 2005 unless further consideration is requested. <br />FINDINGS AND CONCLUSIONS: The findings and conclusions on which the Director based <br />his decision are noted below. <br />1. The property is in the Salem/Keizer Urban Growth Boundary (UGB) and is designated <br />Single Family Residential in the Salem Area Comprehensive Plan (SACP). The parcel is <br />zoned RS (SINGLE FAMILY RESIDENTIAL) under the jurisdiction of Marion County. <br />2. The property is located on the east side of 45th Avenue NE, approximately 235 feet north <br />of the intersection of Marguerite Street and 45th Avenue. The property contains a single- <br />family dwelling and accessory structure. The parcel was legally created as Parcel 1 of <br />Partitioning Case 90-55 (P90-55). <br />3. Properties to the north, south, and east are low density residential subdivisions that are <br />zoned RS. Chemeketa Community College is located to the west and zoned P (PUBLIC). <br />4. The applicant proposes to divide a 20,782 square foot parcel into three lots of 6,000 <br />square feet, 6,000 square feet, and 8,755 square feet each. The existing dwelling will <br />remain on the easterly parcel, and the newly created vacant parcels will be available for <br />development. As proposed, the applicants indicated access to the new parcels via an <br />access easement. <br />The applicant submitted a revised site plan to reconfigure the lots in order to meet access <br />as well as dwelling setback standards for the existing and proposed development. <br />Marion County Department of Public Works reviewed the proposal and provided the <br />following comments: <br />"Approval of the proposal will create an additional home sites on the subject <br />property resulting in additional traffic on 45th Avenue. The Public Works <br />Department has the following comments, requirements, and recommendations for <br />the proposed partition: <br />STREETS <br />45th Avenue is currently a turnpike section; this does not meet County standards <br />for a local urban street. The developer shall construct a half street improvement <br />along their frontage on 45th Avenue to include: widen the existing road width to a <br />seventeen -foot paved half -street improvement, curb and gutter, tapers and <br />transitions to the existing property line sidewalk, and storm drainage elements as <br />required. All improvements shall be built to Marion County Engineering and <br />Construction Standards. <br />In accordance with Marion County Driveway Ordinance #651, driveway permits <br />will be required for any new access or change in existing access to the public <br />right-of-way. Through the building permit process, the applicant shall be required <br />to apply for a driveway permit and construct any improvements required by the <br />
