NOTICE TO MORTGAGEE, LIENHOLDER, VENDOR, OR SELLER: ORS CHAPTER 215 <br />REQUIRES THAT IF YOU RECEWE THIS NOTICE, IT MUST PROMPTLY BE FORWARDED <br />TO THE PURCHASER. <br /> <br /> NOTICE OF DECISION <br /> URBAN PARTITIONING CASE NO. 02-24 <br />APPLICATION: Application of Howe Home Construction to divide a 36,920 square foot (0.85 <br />acre) parcel into three parcels containing two parcels of 7,680 square feet, and one parcel of <br />15,480 square feet each in an LID (Urban Development) zone located Off g5th Ave NE on <br />Fcllowship Way. (T7S, R2W, Section 7DD, Tax Lot 305) <br /> <br />DECISION: Notice is hereby given that the Planning Director for Marion County has APPROVED <br />the above described Partitioning application subject to certain conditions. <br /> <br />This approval is valid only when the final partitioning plat is recorded by NOVEMBER 14~ <br />2004. After recording the final partitioning plat, the applicant shall Provide proof of the <br />recording to the Plauning Division. This can be either a copy of the recording fee receipt or a <br />copy of the plat showing the County Clerk's stamp. The effective period of an approved <br />application may be extended for an additional year subject to approval of an extension <br />(Extension form available fi.om the Planning Division). Additional extensions may not be <br />granted if the regulations under which this decision was granted have changed since the <br />original approval. <br /> <br />This decision does not include approval of a building permit. <br /> <br />CONDITIONS: The following conditions must be met before a building permit can be obtained <br />or the approved use established: <br /> <br />The applicant shall submit a final partitioning plat to the County Surveyor's Office (5155 <br />Silverton Road NE). Following plat approval, it shall be recorded with the Marion <br />County Clerk (final plat instructions and example enclosed). <br /> <br />The applicant is advised that a Partition Plant Service Report, prepared by a title <br />company, will be required upon submission of the final mylar to the County Surveyor. <br /> <br />Prior to submitting the final partitioning plat, the applicant shall contact the Marion <br />County Department of Public Works, (contact person is Byron Meadows 588-5036), and <br />satisfy any of their requirements as indicated in the Findings section #4 of this report. <br /> <br />4. No parcel shall contain less than 6,000 square feet. <br /> <br />Prior to submitting the final partitioning plat, the applicant shall contact the Marion <br />County Building Inspection Division, (588~5147), and satisfy any of their requirements. <br /> <br />ADDITIONAL CONDITIONS: Once the approved use is established the following conditions <br />must be continually satisfied: <br /> <br />After the final partitioning plat has been recorded no alteration of property lines shall be <br />permitted without first obtaining approval fi.om the Planning Director. <br /> <br />If the proposed dwelling is completed prior to the completion of the conditions of <br />approval of this application, the applicant shall meet the conditions of ~ ~ <br />as they pertain to MCUZO 15.30(b). ~ ~ <br /> OCT 3 1 2002 <br /> PUBLIC WORKS <br /> <br /> <br />
