been approved for regular or sand filter disposal systems. <br />Applicant's total ownership is in three parcels, including the <br />subject parcel, and septic site approvals were granted for each of <br />those three parcels. Septic approvals are common in the area, and <br />it is likely that adequate space for wastewater disposal can be <br />provided for each new parcel. A septic site evaluation will be <br />required for each parcel to confirm that an adequate septic system <br />can be installed. With a condition of approval requiring septic <br />site evaluation approval by the Marion County Building Inspection <br />Division, the wastewater disposal portion of rural residential <br />development policy 9 will be met. <br /> <br />The subject site is within an identified geologic slide hazard <br />area. Under MCZO 110.837(b), to ensure land uses and structures <br />are not adversely affected by unstable soils, prior to issuance of <br />any building or zoning permit on lands identified as a potential <br />geologic hazard the applicant shall provide either: 1) a report by <br />an engineering geologist demonstrating that the proposed <br />development site is not effected by a geologic hazard and will not <br />increase the potential for slope instability for other property; <br />or 2) construction plans prepared by an engineer and evidence <br />showing that the development design is adequate to overcome the <br />geologic hazard and the development will not increase the <br />potential for slope instability on adjacent property. MCZO chapter <br />182 also applies. <br /> <br />Under MCZO 182.040: <br /> <br />{A) <br /> <br />The county shall grant approval to alter the condition of any <br />land, water or vegetation, or to construct or alter any <br />structure or improvement including, but not limited to, the <br />following regulated activities within identified landslide <br />hazard and excessive slope areas and as permitted in the <br />underlying zone and applicable overlay zones, after receipt <br />of an approved site assessment, engineering geology report, <br />or geotechnical report as required by this chapter that <br />concludes development does not pose an elevated hazard risk <br />to property. <br /> <br />(i) <br /> <br />Building permits: buildings customarily provided in <br />conjunction with farm use, residential, commercial, or <br />industrial; <br /> <br />(2) Excavation; <br /> <br />(3) Filling; <br /> <br />(4) Subdivisions, partitions, <br /> mobile home parks, <br /> <br /> planned'unit developments (PUDs), <br />and recreational vehicle (RV) parks; <br /> <br />P 02-22 - ORDER -9 <br />KOLOEN ~ <br /> <br /> <br />
