existing private driveway of a width not less than 20
feet. A private drive shall not serve more than four
dwelling units unless the parcels, on which those units
are proposed to be placed, were established with the
approval of the Marion County Planning Commission or
Hearings Officer in accordance with State law and
Marion County Ordinances, prior to May 1, 1977, or were
approved under Chapter 121, Planned Development.

Under MCSPO VII6(b):

When an access easement or access ownership less than
60 feet in width and more than 100 feet in length is to
serve two or more lots in any partitioning, the
location and improvement of the roadway access shall
conform to the following standards which are necessary
for adequate access for emergency vehicles. Evidence
that the access has been improved to these standards
shall be provided prior to the issuance of building
permits on the parcels served by the access easement.

(a) Have a minimum easement width of 20 feet;

(b) Have a maximum grade of 15%;

(c)

Be improved with a paved surface inside an urban
growth boundary and an all-weather surface in
rural areas with a minimum width of 12 feet in
either case;

(d)

Provide adequate sight-distance at intersections
with public roadways;

(e)

Be provided with a road ngme sign at the public
roadway as an identification for emergency
vehicles.

The Salem Suburban Fire District has stricter 20' improvement
and 12% requirements, along with turning radius, turnaround and
premises identification standards.

Parcel 1 access. Access to parcel 1 is proposed via access
easement over parcel 84W24C 500 and applicant's neighboring
property that is proposed for partitioning (84W24C 903). There
seems to be no question about applicant's right to use the
undeveloped easement for access to parcel 1. The issue appears to
be whether the easement can be adequately developed.

P 02-21 - ORDER -14
KOLOEN
