<br />7. <br /> <br />it vacated only the streets within the plat, and the blocks remain <br />separate lots, each enlarged by a half share of vacated right-of- <br />way. <br /> <br />6. <br /> <br />The Planning Division staff found that the county court's 1899 <br />vacation order was effective, and that it eliminated all blocks <br />and streets within the Mission Farm addition, including the blocks <br />and streets containing the subj ect property. The Planning Division <br />staff also found that all transfers relating to the subject <br />property were conveyances by metes and bounds descriptions. <br />According to the Planning Division, the vacation of the plat or <br />conveyance by a metes and bounds description is enough to vacate <br />the block lines contained within the subject property. Based on <br />its analysis, the Planning Division staff determined that <br />applicant has only one legal lot. <br /> <br />In 1899, the Roman Catholic Archbishop of the Diocese of Oregon <br />asked the county court to vacate the Mission Farm addition to the <br />City of St. Paul and certain streets within the originally platted <br />city. On October 5, 1899, the county court issued the following <br />order: <br /> <br />It is therefore ordered that the prayer of said <br />petitioner be granted and that the following streets <br />and additions to the town of St. Paul be vacated, viz. <br /> <br />The addition to the town of st. Paul as laid out by <br />W. H. Gross and recorded in said County on the 16th day <br />of February 1891 in book of town plats vol. 2 on page <br />16 thereof. <br /> <br />Also vacating all streets in the town of St. Paul, said <br />County and State, except those adjacent to and abutting <br />the following blocks in the said town of St. Paul, to- <br />wit, Blocks numbered forty-five (45), forty-four (44), <br />one hundred and nine (109), sixty-two (62), thirty- <br />seven (37), thirty-eight (38), thirty-five (35), <br />thirty-six (36), twenty-nine (29), thirty (30), twenty- <br />eight (28), twenty-seven (27), thirteen (13), fourteen <br />(14), twelve (12), five (5) and the west half of Block <br />thirty-one (31), which said block thirty-one is on the <br />north side of Center Street. <br /> <br />Applicant interprets this order as vacating only streets within <br />the Mission Farm plat, and not blocks. Applicant assigns <br />significance to different recording dates on the Mission Farm <br />addition plat map and plat narrative. The plat map is annotated <br />as recorded on January 22, 1891, and the narrative is annotated <br />as recorded February 16, 1891.
