Applicant submitted a list of proposed uses (exhibit 3). The uses <br />are labeled primary, secondary and limited uses. Applicant does <br />not explain how these labels correlate to MCUZO use categories, <br />but the hearings officer believes they should correspond to <br />allowed, conditionally permitted and prohibited uses. The <br />following uses should be allowed uses: cafe/deli (no drive <br />through), neighborhood tavern (in conjunction with caf6/deli), <br />barber shop, beauty shop, dry cleaner (no drive through), laundry <br />(self service), shoe repair and notary public. The following uses <br />should become conditional uses: telephone answering service, <br />insurance office, professional offices, florist shop, jewelry <br />repair, hearing aid store, charitable organization, music school, <br />dance school, and driving school. All other uses should be <br />prohibited. <br />20. CONCLUSION: Salem has been undergoing an intensive search for land <br />to add to its multifamily inventory, but apparently cannot provide <br />data on its inventory. Since this is a small parcel, the effect <br />on the Commercial and Multi -Family inventory will be minimal. With <br />suggested conditions of approval, applicant can meet al -1- criteria <br />associated with this application. Approval is recommended. <br />VI. Recommendation <br />It is hereby found that, with use of a limited use overlay zone <br />on the subject property, applicant will meet the burden of proving the <br />applicable standards and criteria for approval of a comprehensive plan <br />amendment and zone change have been met. Therefore, it is recommended <br />that the application for comprehensive plan amendment and zone change <br />be GRANTED, subject to the conditions set forth below. The conditions <br />are necessary for the public health, safety and welfare. <br />1. Applicant shall submit a detailed site plan to the Planning <br />Division for the review and approval of the Planning Manager. <br />2. Prior to issuance of any building permits for future development, <br />applicant shall provide evidence of compliance with the Marion <br />County Department of Public Works standards. <br />3. Prior to issuance of any building permits for future development, <br />applicant shall provide evidence of compliance with the <br />development standards of Marion County Fire District Number One. <br />4. Applicant shall comply with all MCUZO design standards, and shall <br />install a site obscuring vegetative hedge along it border with UD <br />zoned land to the south. <br />5. A limited use overlay zone shall apply to the subject property. <br />The following uses should be allowed uses: cafe/deli (no drive <br />ZC/CPO1-1\ORDER - 18 <br />LUNDEEN <br />
