The existing house appears to be one and one-half stories. If the height, according to the <br />definition of the Salem Revised Code (SRC), exceeds 15 feet, the City requries a rear yard <br />setback of 20 feet. A rear yard setback of 17 feet for a dwelling unit more than 15 feet in <br />height creates a nonconforming lot. <br />The lot line adjustment is being proposed to accommodate a future partition. City standards <br />require a minimum lot frontage of 40 feet. One of the future parcels does not indicate that <br />width. Both future parcels exceed the maximum lot width to depth ratio. Reconfiguration <br />of the future partition under a flag lot, arrangement with a common accessway should take <br />into consideration the proximity of the street intersection. Lot size could be impacted by the <br />need for additional right-of-way. <br />There is a curb but no sidewalk on Reimann Street. The City's Public Works Department <br />usually requires installation of sidewalks at the time of building permit. Utility accessibility <br />also needs to be evaluated as part of both the lot line adjustment and the partition, including <br />the dedicating of any necessary private or public utility easements. <br />Although not indicated on the preliminary plan, there'are several large trees on the property. <br />City staff recommends protection of those significant trees defined as, significant according <br />to SRC 132.200 at the time of partition and future development. All other agencies failed <br />to comment or stated no objection to the applicants proposal. <br />5. The applicants propose to: adjust the lot lines on a 7,705 square foot parcel and a 11,328 <br />square foot parcel to create a 6951.88 square foot parcel and a 12,081.12 square foot parcel. <br />Both parcels were created through the review and approval of Partitioning Case 96-48 and <br />the subsequent recording of Partitioning Plat 98-38. <br />6. The following regulations apply when lot line adjustments and partitioning of land within <br />the UD zone as regulated by the Marion County Subdivision and Partitioning Ordinance are <br />proposed: <br />(a)- Existing lots with dwellings: The -dwelling and immediately surrounding area may <br />be separated from the remaining, property provided: <br />(1) The location of lot lines shall not significantly reduce feasible options for the <br />fixture location of urban roads or services, or preclude basic development <br />options on the property or adjacent properties. ' If the applicable comprehen- <br />sive plan designates the property for single family residential uses a develop- <br />ment plan may be required which, demonstrates that the proposed division <br />will not preclude- future subdivision achieving the median density proposed <br />in the Comprehensive Plan. <br />(2) Any additional street right-of-way required by adopted standards is dedicated <br />along the lot's street frontage. <br />
