the basis of new information subject to signing an extension of the 150 day time limit for review <br />of zoning applications. <br />A public hearing is held on appeals subject to the appellant paying a $250.00 fee. Requests for <br />reconsideration, or consideration by the Hearings Officer, must be in writing (Appeal Form <br />available from the Planning Division) and be received in the Marion County Planning Division, <br /> AUGUST 18, 2000 <br />. <br />3150 Lancaster Dr. NE, Suite B, Salem, OR 97305 by 4:30 p.m. on <br />Please note an appeal directly to the Land Use Board of Appeals is not allowed under ORS <br />197.830. This decision is effective <br />2000 <br /> unless further consideration is requested. <br />FINDINGS AND CONCLUSIONS: <br /> The findings and conclusions on which the Zoning <br />Administrator based the decision are noted below. <br />1.The property is located inside the Salem/Keizer Urban Growth Boundary and is desig- <br />nated Commercial in the Salem Area Comprehensive Plan. The property is zoned CO <br />(Commercial Office) under the jurisdiction of Marion County. The purpose of this zone is <br />to provide areas suitable for professional and general commercial offices, membership <br />organizations, similar low intensity non-retail commercial services and medium density <br />residential accommodations. <br />2.The property is located on the east side of Lancaster Drive NE, approximately 400 feet <br />north of its intersection with Monroe Avenue NE. The property is vacant land. <br />3.Surrounding uses include an office on property to the south while property to the east is <br />owned by the applicant and currently contains two dental clinics. The subject parcel <br />apparently provides some of the parking for the dental offices. These properties are also <br />zoned CO. Property to the north is zoned CR (COMMERCIAL RETAIL) and contains <br />the parking area for the Discovery Zone. Lancaster Drive borders the property on the <br />west. <br />4.The applicants intend to construct an office building on the parcel to use as a dental clinic <br />and requested an adjustment to allow a portion of a building over 15 feet high to be <br />located closer than 10 feet to an interior side yard. However, additional information <br />received from the applicant established that the proposed building would not exceed 15 <br />feet in height. Therefore, a 5 foot setback from the north property line is appropriate <br />under Section 5.14(a) and the adjustment is not necessary. The request is also to reduce <br />the required 12 foot front yard setback from the private access easement that extends <br />along the south property line. Staff also notified the applicants that a 24 foot wide <br />driveway easement is required instead of the 20 foot right-of-way indicated on the site <br />modified <br />plan. Subsequently, the applicants requested a proposal to reduce the width of <br />the easement to 20 feet. <br /> <br />
