PROCEDURE: <br /> The Marion County Zoning Ordinance provides that certain Conditional Use <br />applications be considered first by the County Planning Director. If there is any doubt that the <br />application conforms with adopted land use policies and regulations the Director must condition <br />or deny the application. Any interested person who disagrees with the Director's decision may <br />request that the application be considered by the Marion County Hearings Officer after a public <br />hearing. The applicant may also request a reconsideration (one time only and a fee of $200) on <br />the basis of new information subject to signing an extension of the 150 day time limit for review <br />of zoning applications. <br />A public hearing is held on appeals subject to the appellant paying a $250.00 fee. This decision is effective unless <br />further consideration is requested. <br />FINDINGS AND CONCLUSIONS: <br /> The findings and conclusions on which the Zoning <br />Administrator based the decision are noted below. <br />1.The subject property lies within the Salem Urban Growth Boundary (UGB) and is <br />designated “Single Family Residential” in the Salem Area Comprehensive Plan. The <br />parcel’s UD (URBAN DEVELOPMENT) zone is under the jurisdiction of Marion <br />County. The major purpose of both this designation and zone is to provide areas for <br />future residential development at low urban densities. <br />2.The parcel is located at the southeast corner of the Hayesville Drive and Reimann Streets. <br />3.Properties on all sides of the subject parcel are slated for single family residences. <br />4. The undeveloped parcel was created in 1996 as a result of Partitioning Case 96-48 and the <br />subsequent recording of Partitioning Plat 98-38. <br />5.In staff contacts with Lauryl Byer at the Marion County Department of Public Works the <br />proposed reduction in the front yard setback from 20 to 12 feet along Hayesville Drive <br />and 14 feet along Reimann Street was not judged as a problem with future improvements <br />to either Hayesville Drive or Reimann Street. <br />Marion County Fire District Number One commented that the adjustment is “OK” but if <br />building occurs must resubmit. <br />All other contacted agencies either failed to respond or stated no objection to the proposal <br />at the time this report was written. <br /> <br />
