ARTICLE III. <br /> SUCCESSOR TRUSTEES <br /> A. If I am disabled or am unable to serve for any other reason, including at my <br /> death, then STEVEN L. BROADY shall serve as 7 rustee. If STEVEN L. BROADY is disabled <br /> or is unable to serve for any other reason,then SUSAN L. BROADY shall serve as Trustee. <br /> B. Determination of Disability. A Trustee or Trustor shall he deemed disabled <br /> during any period when, in the opinion of two healthcare professionals, the Trustee or Trustor is <br /> incapacitated or disabled because of illness, age, or any other cause which results in the inability <br /> to effectively manage his or her property or financial affairs. For the purpose of determining <br /> disability, a healthcare professional shall only include licensed physicians, psychiatrists, <br /> psychologists, social workers, nurse practitioners and professional case managers. The <br /> determination must be in writing and signed by the healthcare professional making the <br /> determination. <br /> C. Court Determination. A Trustee or Trustor shall also be deemed to be disabled <br /> upon the determination of a court of competent jurisdiction that he or she is incompetent, <br /> incapacitated, or otherwise legally unable to effectively manage his or her property or financial <br /> affairs. <br /> D. Waiver of Privilege. If necessary in order to obtain the opinion of a physician, <br /> healthcare professional or other specialist regarding my disability or incapacity, I waive any <br /> physician-patient privilege or other privilege which otherwise would protect me against the <br /> disclosure of confidential information and authorize the release of medical information to the <br /> extent reasonably necessary for this purpose. <br /> E. Nonliability of Trustee. My trustee or successor trustee who relies in good faith <br /> on a determination of incapacity shall not be liable for any acts or omissions resulting from that <br /> determination. <br /> F. Contesting Incapacity. If I object to a determination or proposed determination <br /> of incapacity, I reserve the right to contest the question of incapacity.
