I/We certify that I/We fully understand that the construction of a residence or the placement of a manufactured <br /> home on the above described real property is a replacement residence for the existing residence located on the <br /> property and is approved only on that condition. <br /> 2. I/We certify that within ninety(90),days of occupancy of the new residence,UWe shall provide evidence to the <br /> Planning Division that the replaced residence has been removed,demolished,or converted to an allowable non- <br /> residential use. <br /> 3. I/We also acknowledge that in order to convert the replaced residence to an allowable non-residential use,I/We <br /> shall file a Declaratory Statement regarding the use of the replaced residence and prohibiting its use as a residence <br /> (Declaratory Statement available from the Planning Division). <br /> 4. I/We realize it is not the intent of this permit to subvert the intent of the Single Family zones or any other zones <br /> by permitted more than one permanent residence on each property. <br /> Owners do hereby promise and covenant as follows: The property herein described is situated in or near a farm or forest zone <br /> or area in Marion County, Oregon where the intent is to encourage, and minimize conflicts with, farm and forest use. <br /> Specifically,residents,property owners and visitors may be subjected to common, customary and accepted farm or forest <br /> management practices conducted in accordance with federal and state laws that ordinarily and necessarily produce noise,dust, <br /> smoke and other impacts. <br /> The grantors,including their heirs,assigns and lessees do hereby accept the potential impacts from farm and <br /> forest practices as normal and necessary and part of the risk of establishing a dwelling, structure or use in this area,and <br /> acknowledge the need to avoid activities that conflict with nearby farm and forest uses and practices grantors will not <br /> pursue a claim for relief or course of action alleging injury from farming or forest practice for which no action is allowed <br /> under ORS 30.936 or 30.937. <br /> This covenant will run with the land and is intended to and hereby bind owners,their successors,heirs,assigns and lessees. <br /> page 1 of 3 <br />
