M. <br />THE PURPOSE OF THIS SURVEY IS TO ESTABLISH CONTROL, RETRACE THE EXISTING RIGHT-OF-WAY (R/W) AND <br />PERPETUATE THE LOCATION OF MONUMENTS THAT MAY BE DESTROYED DURING CONSTRUCTION ON THE K22205: OR99E <br />CURB RAMPS PROJECT, IN COMPLIANCE WITH ORS 209.155. THIS SURVEY WAS PERFORMED BY ODOT CREWS FROM <br />AUGUST 2020 THROUGH FEBRUARY 2021. <br />THE BASIS OF BEARINGS AND HORIZONTAL COORDINATES ARE ON OREGON COORDINATE REFERENCE SYSTEM (OCRS) <br />PORTLAND ZONE, WITH A REALIZATION OF NAD83 (2011), EPOCH 2010.00. <br />NETWORK CONTROL POINTS WERE SET ALONG THE PROJECT CORRIDOR AND TIED WITH TWO - 60 EPOCH RTK <br />OBSERVATIONS, AVERAGED, AND THEN TIED TOGETHER BY TERRESTRIAL OBSERVATIONS BETWEEN POINTS. A <br />SIMULTANEOUS LEAST SQUARES ADJUSTMENT WAS PERFORMED ON THE DATA. MONUMENTS WERE TIED FROM PROJECT <br />CONTROL, OR TIED WITH TWO - 60 EPOCH RTK OBSERVATIONS AND AVERAGED WHERE PRACTICAL. <br />HIGHWAY 99E <br />I HELD RECORD DEFLECTIONS AND CURVE DATA PER ODOT DRAWINGS 1A-2-36 AND 1A-2-39. TANGENTS WERE <br />SHORTENED TO BEST-FIT/HOLD ODOT MONUMENTS 1022, 1 040, 1050, 1 051 , 1053, 1093, 1 089 & 1 090 (CITED I N <br />ORDER FROM SOUTH TO NORTH). A 9.67 -FOOT SOUTHERLY OFFSET FROM THE MEASURED CENTERLINE OF THE <br />PUDDING RIVER BRIDGE WAS HELD FOR CENTERLINE ALONG THAT TANGENT SECTION PER THE 1945 BRIDGE PLANS <br />(CONTRACT PLAN NO. 3V-333). ODOT MONUMENTS 1063 AND 1064 (BOTH BENT) FIT THIS SOLUTION REASONABLY <br />WELL. RECORD OF THE MONUMENTS ARE DETAILED IN ODOT FIELD BOOKS NO'S 936, 938 & 2313, BUT NOT SHOWN <br />ON ANY ODOT MAPS. RECORD WIDTHS WERE HELD PER SAID MAPS AND THE DEEDS CITED THEREON. <br />THE WESTERLY R/W LINE WEST OF THE PLAT OF "KRAUS' ADDITION" IS THE ORIGINAL COUNTY ROAD R/W LINE. <br />THIS WAS CALCULATED BY HOLDING 60.00 FEET WEST OF THE WEST LINE OF BLOCK 2 PER SAID PLAT. THE PLAT <br />DIMENSIONS FOR BLOCK 2 WERE HELD BASED ON THE RESOLVED R/W LINES OF MAIN, THIRD AND FOURTH STREETS <br />AS SHOWN HEREON. THIS WAS THE BEST EVIDENCE FOUND OF THE COUNTY ROAD R/W LINE. MCSR 31629 <br />MONUMENTED AN AGREEMENT LINE FOR THE R/W. EVIDENCE OF A PROPOSED AGREEMENT IN 1987 WAS FOUND IN <br />CORRESPONDENCE LOCATED IN ODOT RW FILE NO. 01108, ALTHOUGH NO FORMAL AGREEMENT WAS FOUND ON FILE. <br />PREVIOUS RESEARCH CONTAINED IN THE SAME ODOT FILE MADE THE SAME FINDING AS I, THAT THE ORIGINAL <br />COUNTY R/W HAS NOT BEEN VACATED. THE CONCLUSION I HAVE MADE, PENDING FURTHER TITLE RESEARCH, IS <br />THAT THE ORIGINAL COUNTY R/W LINE IS CONTROLLING. HOWEVER,THE LANDOWNER MAY HAVE GAINED THE RIGHT <br />TO USE THE AREA BETWEEN THE R/W LINE AND THE AGREEMENT LINE. <br />ORCHARD AVE. <br />ORCHARD AVENUE INTERSECTION WAS LOCATED BY HOLDING A BEST FIT OF PLAT MONUMENTS AND DATA, PER <br />"ORCHARD VIEW", BUT NOT FULLY RESOLVED. <br />OTTAWAY RD. <br />EAST OF THE HIGHWAY, OTTAWAY ROAD WAS ORIGINALLY 10 FEET WIDE EACH SIDE OF THE QUARTER -SECTION LINE <br />AS SHOWN ON 1A-2-36. ODOT THEN BOUGHT A 20 -FOOT STRIP ON THE SOUTH SIDE AS PER VOLUME 215, PAGE <br />571, MCDR. THE MONUMENTED R/W LINES PER "NEW COLONY PARK", MCSR 17996 AND NEWER SURVEYS DID NOT <br />APPARENTLY LOCATE THE QUARTER -SECTION LINE ACCURATELY. I HELD THE SOUTH LINE PER "NEW COLONY <br />PARK", AND THE NORTH LINE PARALLEL TO THE SOUTH LINE AND PER REEL 2658, PAGE 323, MCDR. THESE <br />EXPANDED THE DEDICATED RIGHT-OF-WAY FROM THE ORIGINAL WIDTH AND WERE HELD AS CONTROLLING OVER THE <br />QUARTER -SECTION LINE. <br />WEST OF THE HIGHWAY, I HELD THE MONUMENTED R/W LINES AS PER "GATEWAY AURORA" AND PARTITION PLAT <br />92-103. THIS PORTION OF RIGHT-OF-WAY IS ALSO NOT CENTERED ON THE QUARTER -SECTION LINE, ALTHOUGH IT <br />MAY HAVE BEEN INTENDED TO BE ORIGINALLY. I HELD THE LONG ACCEPTED (AND NOW PLATTED) LOCATION <br />RATHER THAN THE QUARTER -SECTION LINE. THE QUARTER -SECTION LINE WAS CALCULATED HOLDING THE CENTER OF <br />SECTION MONUMENT 1075 AND A 22.08 -FOOT OFFSET FROM MONUMENT 1074 PER "GATEWAY AURORA". <br />THE CENTERLINE OF MAIN STREET WAS EXTENDED SOUTHERLY 1.47 FEET FROM 1078 TO LOCATE ITS INTERSECTION <br />WITH BOB'S AVENUE. THIS CREATES A FULL 430.00 FEET FROM THE ANGLE POINT AT 1081, WHICH IS RECORD <br />LENGTH PER PLAT AND MCSR5461. FROM SAID INTERSECTION POINT, RECORD TURNED ANGLE OFF OF THE <br />CENTERLINE OF MAIN STREET WAS HELD FOR THE CENTERLINE OF BOB'S AVE, PER "SNYDERS ADDITION" AND <br />MCSR 5461. STREET IMPROVEMENTS (BACK OF WALK) ON THE NORTH AND SOUTH SIDE OF THE STREET FIT THIS <br />SOLUTION VERY WELL. 1078 WAS NOT HELD FOR BOB'S AVE. BECAUSE IT WOULD HAVE PUT STREET IMPROVEMENTS <br />OUTSIDE OF RIGHT-OF-WAY, CAUSED A DEFICIENCY ON THE NORTH SIDE AND AN EXCESS ON THE SOUTH SIDE <br />WITHIN "SNYDER'S ADDITION". <br />FOURTH STREET/MAIN STREET <br />MONUMENT 1083 WAS HELD AS AN ORIGINAL PLAT MONUMENT TO "KRAUS'S ADDITION", AND BEST EVIDENCE OF THE <br />DEDICATED RIGHT-OF-WAY. RECORD ANGLE WAS HELD OFF OF MAIN STREET PER MCSR 5461, THROUGH MONUMENT <br />1083. THE BUILDING CORNER SHOWN IS A GOOD CHECK ON THIS SOLUTION, BEING 0.1' NORTH OF THE COMPUTED <br />R/W LINE. RECORD PLAT WIDTH OF 40 FEET WAS HELD, WHICH INCLUDES THE PORTION DEDICATED BY HENRY <br />KRAUS (SHOWN ON SAID PLAT AND AS STATED IN PLAT DEDICATION). THIS LEAVES A 10 -FOOT STRIP THAT WAS <br />ORIGINALLY OWNED BY HENRY KRAUS, BUT WAS NOT DEDICATED, AS SHOWN IN VARIOUS SURVEYS. MCSR 5461 WAS <br />IN ERROR SHOWING THE R/W WIDTH OF 50 FEET AND THE CURRENT VESTING DEED INCLUDES THE 10 -FOOT STRIP. <br />THE PORTION OF MAIN STREET CENTERLINE BETWEEN BOB'S AVE. & FOURTH ST. WAS RESOLVED BY HOLDING <br />MONUMENT 1078 FOR CENTERLINE AND A 27.00 -FOOT OFFSET FROM 1081 & 1084, WITH AN ANGLE POINT AT THE <br />NORTH LINE OF "SNYDERS ADDITION" (AS DEFINED BY 1081) PER MCSR 5461. <br />FROM FOURTH STREET NORTH, A 33.00 -FOOT OFFSET WAS HELD FROM 1083, AND 1087, 1008 & 1028 WERE HELD <br />FOR CENTERLINE, ALL PER MCSR 5461. STATIONING SHOWN ON MAIN STREET IS CREATED BY THIS SURVEY TO BE <br />USED FOR THE SUBJECT PROJECT. <br />PLAT OF "AURORA" STREETS, WEST PORTION OF THIRD STREET, EHLEN ROAD <br />CENTERLINE MONUMENTS FROM MCSR 5461 WERE HELD FOR LOCATION ON THIRD, SECOND & LIBERTY STREETS, AND <br />RECORD WIDTHS PER PLAT OF "AURORA" AND "KRAUS' ADDITION". FOR THIRD STREET WEST OF THE HIGHWAY, <br />RECEIVED 11/22/2021 BY RECORD WIDTH OF 40 FEET WAS HELD SOUTHERLY FROM THE SOUTH LINE OF <br />BLOCK 2, "AURORA" AS PER THE 1901 DEDICATION IN VOLUME 78, PAGE 120, <br />MARION COUNTY SURVEYOR. MCDR. <br />APPROVED FOR FILING ON <br />01/12/2022. EHLEN ROAD WAS LOCATED BY HOLDING RECORD CENTERLINE DATA FROM MCSR <br />35903, HOLDING MONUMENT 1027 & A 29.90' OFFSET FROM MONUMENT 1031 PER <br />SAID SURVEY.
